Maharashtra DGP's appointment set aside by HC

Mumbai In a significant judgment that would have far-reaching implications on future appointments, Bombay High Court on Thursday set aside the appointment of appointment of senior IPS officer Anami N Roy as Maharashtra's Director General of Police. The judgment came in wake of a Central Administrative Tribunal (CAT) order that had in October set aside Roy's appointment.

The High Court has directed the state Government to start the selection process and appoint a new DGP within four weeks. The court has, however, stayed the judgment for a period of two weeks for the aggrieved parties to move the Supreme Court.

The court has also passed strictures against the government and observed that the whole selection procedure was based on irrelevant considerations, non-application of mind and arbitrarily.

In October, CAT had set aside the appointment of Roy following an application moved by Suprakash Chakravarti, the-then DGP, Homeguards and currently the DG, ACD. Holding that the state was bound to consider the three officers who were senior to Roy for state DGP's post, CAT held that the whole process of selection and appointment of A N Roy is untenable in law and on facts. Hence a direction is required to the state Government to convene the meeting of review selection process by duly taking into consideration three senior-most officers.

Mr. Roy was appointed by the Congress government in Maharashtra without following the norms and naturally, he would be obliged to his political bosses. ATS chief Mr. Karkare was reporting to him. Earlier, Mr.Karkare had complained of pressure in relation to the Malegaon blast investigations. Some cabinet ministers of the UPA wanted a ban on RSS and other Hindu organizations as a pre-condition to re-impose the ban on SIMI. So, was mr. Karkare under pressure to find evidence against Hindu organizations?

Added to that it is known that the post is sold to the highest bidder. For the failure of 26/11 both an roy and gaffoor should have been dismissed from the service.

What Mr Raj Thackeray is doing in his own methods is trying to find justice for the downtrodden patriotic and justifiably proud Maharashtrians who have trusted their Congress leaders only to taste betrayal at the end. what do you expect he should do if his land is filled with filth from all over in the most crooked manner and the original Maharashtrians are made to eat rot from the hands of the idiots who occupy cahirs by hook or crook? An humble correction, Mr. Indian. The remark in question was actually made by Shri. Prasad,Joint Police Commnr. Mumbai, and this particular piece was telecast by the TV channels. Afterwards, some uncharitable comments were made about this utterance by politicians in power

What for do we have Home Secretary and Chief Secretary? Or were they also busy subverting the legal procss? High Court's strictures really apply to them.

Is Mr Roy a Christian?I mean it is very difficut to win confidence of Soniaji without that being the basic qualification as far as govt postings are concerned. From the time Rajiv passed away till date, there has been sanitization of various institutions, but soniaji is bringing back ethos of indira gandhi with a vengeance. A N Roy, Chawla, MS Gill, Shivraj Patil, YSR - the no. of people who occupy position due to their alleigance to ammaji is relatively long. Collectively their performance is mediocre and each except Mr Gill have brought calamity or tried to bring it (as in case of Navin Chawla) when assigned with a responsibility. Of course Mr Manmohan is the only exception and there is room to suspect is that loyalty is the price Mr Manmohan pays to do good for the country.
