Malegaon: MCOCA slapped on accused, PM dials Advani

Malegaon

Mumbai, November 20: The Anti-Terrorism Squad (ATS) on Thursday invoked the stringent Maharashtra Control of Organised Crime Act (MCOCA) against the ten accused arrested so far in the September 29 Malegaon blast case.

One more suspect would be arrested soon, ATS chief Hemant Karkare said at a press conference.

Karkare said the case would now shift to the special MCOCA court in Mumbai. Currently, the proceedings are underway at a court in Nashik district, under which Malegaon falls.

MCOCA allows police to keep an accused in custody longer than in ordinary case, before the chargesheet is filed.

He said that ATS' current ‘focus’ was only on the Malegaon blast case, and not on Samjhauta Express explosions of 2007.

The police officer said ATS was expecting some vital evidence to emerge from scrutiny of the laptop of Sudhakar Chaturvedi, one of the accused.

The investigation would be hopefully completed within 90 days, Karkare added.

No political pressure on us in Malegaon probe: ATS chief

Rebutting senior BJP leader L K Advani's charge, Maharashtra Anti-Terrorism Squad said there was no political pressure on it in handling the Malegaon blast probe nor was there any substance in the charge that accused Lt Col P S Purohit was tortured in custody.

"There is zero political pressure and we are working professionally. Purohit has said in open court that ATS has not ill treated him," ATS head Hemant Karkare said.

Regarding Advani's allegation that Sadhvi Pragya Singh Thakur, another arrested accused in the case, was ill treated by the ATS, he said the matter was sub-judice and he would not like to say anything at the moment.

Karkare said, "despite media reports and his (Purohit's) relatives saying he was ill treated he told the court that there was no such thing."

Dayanand Pandey had also said he was ill treated but the court did not see any marks and medical reports also found the allegations to be incorrect, Karkare said.

Pandey, when produced in a Nashik court on November 14, had alleged he had been physically tortured by the ATS after being arrested. He was taken to the magistrate's chambers where he was examined but no marks of torture were found, he said.

"In this case, like all cases, we adhere to methods prescribed under the CrPC and we use witness statements, technical evidence and interrogation," Karkare said.

PM Manmohan Singh dials Advani

New Delhi, November 20:

Prime Minister Manmohan Singh called up BJP leader L K Advani and raised the issue of his allegations about torture of Sadhvi Pragya Singh Thakur, one of the prime accused in the Malegaon blast case, in connection with the ongoing ATS probe.

During the telephonic conversation on Wednesday, the Prime Minister is understood to have told the Leader of the Opposition that the BJP charges are being looked into by appropriate authorities and that he will get back after ascertaining the facts. The BJP had also raised questions on the neutrality of Maharashtra's Anti-Terrorism Squad (ATS).

Advani is also understood to have raised the issue of affidavit filed in a Nashik court by Sadhvi Pragya Singh Thakur in which she alleging she is being tortured by ATS personnel which he described as ‘barbaric treatment’.

The Prime Minister is also understood to have voiced concern over how religious labels are being given for terror.

Breaking his silence in the Malegaon probe while coming out in support of the Sadhvi,Advani alleged on Tuesday ‘It has become clear that the ATS is acting in a politically-motivated and unprofessional manner’.

BJP president Rajnath Singh and several party leaders have also targeted the ATS and have accused there is a political conspiracy.

Sudhakar was in touch with Purohit: ATS

Sudhakar Chaturvedi, arrested in connection with Malegaon blast case, was the national coordinator of radical group Abhinav Bharat who remained in touch with key accused Lt Col Srikant Prasad Purohit, Anti-Terrorism Squad (ATS) told a court in Mumbai.

ATS was granted transit custody of Chaturvedi by a magistrate court.

Chaturvedi is likely to be produced before a Nashik court on Friday where the ATS will seek his police custody.

He was arrested on November 4 outside suburban Dadar railway station for possession of a country-made revolver and a fake army identity card.

He had undergone scientific tests like brain mapping and narco analysis at the Kalina Forensic Science Laboratory on November 18.

During police interrogation Chaturvedi said the revolver and the identity card was given to him by Purohit. The identity card was a temporary pass which allowed Chaturvedi access into the artillery centre at Deolali camp of the army near Nashik, police sources said.

Chaturvedi, allegedly a former RSS activist, had met Purohit and others accused in the case like Sadhvi Pragya Singh Thakur and Dayanand Pandey at meetings organised by Abhinav Bharat, the sources said.

Advani told the Prime Minister that he was keeping quiet on the issue till now but was forced to speak after seeing the affidavit filed by Pragya in court, a BJP MP said.

Advani also advised the Prime Minister to go through Pragya's affidavit to know the seriousness of the situation.

Singh assured Advani that he will look into the matter, the BJP MP said on condition of anonymity.

Singh informed Advani that he had seen the statement made by the Opposition leader in Chhattisgarh on Tuesday about repeated narco analysis done on Pragya Singh Thakur.

Advani had also said at the public meeting that no women police personnel were present during the tests.

12% Muslim vote at the cost of 80% Majority... by IE Reader on 21 Nov 2008

Any one can understand how biased some of the comments here towards one particular community. The moment a bomb explodes it was blamed on Muslims even without any investigation. A message would come in the form of SMS or E-mail claiming to be from some Muslim Terrorist organization/s. Many Muslims youths and professionals would be arrested and interrogated, torturing them physically and mentally. POTA was grossly misused against them during BJP rule. That time no body was there to talk on behalf of them. Not even Muslims as they were scared that they will have the same fate. Abdul Nasser Madani was held in Coimbatore jail for more than 9 years without any trial. After nine years trial started he was found innocent and released. Who would compensate for the 9 valuable years that he spent in jail away from his family and that too in ill health. Its foolish to believe these thing are done to get votes of 12% or so Muslims population which is divided by the so called secular parties.

ATS : First get some Proof and then Introgate based on that by Shankar on 21 Nov 2008

Maharastra Police do not learn from Punjab police. What did the Panjab police did during Panjab Terrorism, is the same act Maharastra police is doing. Insted of punishing the actual terror culprits they are just picking up the opponents of political and religious people in the name of introgation. This could not solve the problem will increase in moving far away from supporting police. Police are just picking up people based on their doubt and trying to fetch the proof. First let them have the proof and later introgate based on the proof. Even i can prove any person guilty if i have power like Maharastra ATS. Citizens should teach the Mahastra Congress and Central Congress govt about its appeasing minority policy.

POOR EXAMPLE FOR DEMOCRACY by SRIDHAR B on 21 Nov 2008

The action of the ATS is not at all surprising. The action shows whata poor example for democracy is our nation. The ATS claims it has evidence, Then why invoke MCOCA. Hope our Honourable President Madam is watching all these happenings because she was advocating against terse laws to deal with terrorism when she was commenting about the law enacted by Guj. govt pending with Central Govt. Why doesn't she tell her friends in Maharashtra to revoke MCOCA. The congress, left and other secular protection forces and the print and visual media are all inflicting irrepairable damage to our country. Dear Hindu Brothers, Only congress and secular protection forces have full right to misuse acts like MCOCA. The day is not far off when India will become Israel and defend our rights on our own. It is unfortunate that even BJP is in a dilemma because they let go a wonderful opportunity to seize the issue and take it to the HINDUS. This government no longer cares for majority community.

speed of investigation and timing by ashok pai on 21 Nov 2008

the ATS was dormant for 2 years, and now moving at light speed just in time of elections.nobody has yet spoken about hard tangible evidence in the case.if narco analysis is evidence, then when telgi spoke about high and mighty - why werent they quizzed ?how come sanjay dutt is still acting despite having been found with a cache and arms - a normal citizen would have been hung by now.

Malegaon by Dr S.Srinivasan on 21 Nov 2008

The case seems to run on lines parallel to the Sankarraman murder case, which is also sub judice right now. Only difference is Maharashtra's `POTA'in the present case. At least there, Shri Shankaracharya was able to get bail in the Supreme Court by proving the false statements of the Tamil Nadu counsel Tulsi by producing the evidence on the land sale having been credited to the Mutt's bank account. Tulsi said that the money was used to pay hirelings and had to cut a sorry figure in the court. He was, however, lucky that the English language secular(?)media obligingly suppressed these facts. Like Bourbons, media like you never learn. Wait for the final result. The lower judiciary have no powers to pull up the police even when they know that the police are wrong. So, initial developments are bound to be sensational.

Puppet PM by Tushar on 21 Nov 2008

I dont know where this professionalism got lost in the series of terrorist activities where majority community beared the brunt. When Haneef was arrested PM and all those psuedo's lost there sleep, but if the victim is a hindu and a woman too, nobody talks about her human rights ? No evidence but do everything to keep her in custody. We cannot expect anything from this puppet PM . He has lost all credibility , we know how he sent his trusted luietenents (Amar singh and ahmed patel) to buy votes, he can do anything to win this election.

Injustice against Hindus by Manjunath on 21 Nov 2008

What a great mockery of democracy. Secularism is dead in India. In Hindustan , Hindus are the ones who are being looked as second citizens. The anti Hindu Congress party will stop at nothing but the division of this great nation on caste and religious basis. If these type of injustice continues , then days are not far when a seond partition of this country will take place . But this time it would be Hindus who will insist on that. The entire nation should wake up to this injustice and make the congress to repent.

Promoting Terror by R.K.Baqaya on 21 Nov 2008

It looks strange that amongst the hundreds of blasts that have taken place in the country over the years,in which thousands of people died, the ATS has thought it fit to concentrate all its energies on the Malegaon blast in which a mere 6 people died. The grapevine says that Col.Purohit is being framed because when working in Military intelligence he came across evidence indicating the names of some leading politicians of India who were on the payroll of the ISI and other organisations promoting terror in India.

Devide and rule consequences - any alternatives ? by Adab on 21 Nov 2008

If we were to have harmony and peace in this country, how can each one of us contribute to that as human beings. Division and hate is not going to do any good in the long run this is what we have learned from history.Any Thoughts ?

macoca on malegaon culprits by himanshu on 21 Nov 2008

it is very sad affair and as far as hindu terrorist goes visual media has shown its true colours.most of media channels are doing biased reporting and helping ats in disinfo campaign.it seems media channels get some funding from somewhere for this tirade against hindus and this matter should be probed seriously in future.as for slapping macoca on the accused congress and media at el know if these charges against hindu terrorists and army personnel are proved false then god will also be not able to help this goverment and media channels biased in this matter.my country is really in need of a god if he exists in near future, never mind whichever religion this god belongs to .

Advani a super-terrorist as lalu said. by Alex on 21 Nov 2008

Now Advani will decide who is terrorist and who is patriotic !

Make facts of Malegaon case public by Bharat on 21 Nov 2008

The UPA government should be considered evil because it has not come out with facts of 'Malegaon' case. This is clearly a case of conspiracy to attack hindu Dharma by UPA government unless it convinces nation by facts of the matter.

Col. Prasad Purohit by Jatin on 21 Nov 2008

Col. Prasad Purohit is the new age Bhagat Singh. Then the Congress helped eliminate Bhagat Singh and now it is after Col. Prasad Purohit. Col. Prasad Purohit has served the country valiantly before his name cropped up in this case. hes an army officer. he should be treated with respect.

Hindu Editorial by read on 21 Nov 2008

Clearly, the BJP’s stance on Malegaon has nothing to do with the principle that a person must be presumed innocent unless proved guilty. It is a stance of blanket opposition to the law of the land bringing to justice sangh parivar elements accused of terrorist crimes. The double standard aside, the BJP is guilty of seeking to politicise, pressure, and derail the legal investigation of the Malegaon explosions and the conspiracy behind them by Maharashtra Anti-Terrorism Squad. It is particularly shocking that Mr. Advani, a former Union Home Minister, going on nothing but the hysterical words of an accused, charged the ATS with being politically motivated and unprofessional in its investigation. The parivar has a track record of applauding the ATS whenever it acted against alleged Islamist terrorists. Blinded by its communal agenda, the main opposition party has gone dangerously over the top in the cause of Hindutva.

MOCCA-MUST READ by jagtap on 21 Nov 2008

I respect law, let law take it's own step and begin punsihments from Radahbai Chawl event of 1993, where 8 hindues were burnt alive, since 1993, uncounatable blast has occured in INDIA, all those accountable for such a anti-Indian act must be punished, but it will never happen, beacuse 98% accused are muslims and congress do not want to loose their vote bank, so now what happen.....you decide

Yes, we must also cry to implement Sri Krishna Commission by Indian on 21 Nov 2008

Oh yes, Congress is with Muslims and that's the reason the accused of 1992 Mumbai blast got the severe punishments in the court and Sri Krishna Commission is not yet implemented. The Hindu right wing group terrorists are roaming freely and the victims don't hope for justice anymore. Thanks for such a wonderful second class citizen treatment.

In gujrat 58 hindues were burnt alive in godhara including 20 children. It is a natural reaction by hindues and listen, if they burn 10 hindues, calculation will be in multiple of atlest 20.

Keep your Calculation with You by Rahim Chunawala on 21 Nov 2008

If this is your mentality, then why are you crying on govt and ask for investigation. Let the law do it course and keep the calculation with yourself. This way you are justifying terrorism in India. People like you are the root cause of terrorism in India. This is not a jungle as you belong to one, it is a civil society and animals like you are not allowed to roam free. Jai Hind

Just say Vande Mataram by Jagtap on 21 Nov 2008

Sooner or later you will speaking vande mataram after jay hind, so try to be a habituated and write vande mataram after your every post.

stop crying!!!!! by Rahim Chunawala on 22 Nov 2008

I don't have any problem in writing jai hind or vande matram, it means the same, but it does not suit you to say either of it, coz you are anti national and traitor to the country. I hope you can shift to nepal to stay with 100% hindu population, but I think even there you will have hundred of problems, coz people like you only know to create problems, here you go over muslims, there you will fight creating caste differences, lower and uppers caste. You will never be satisfied. Jai Hind

Keep dreaming Mr. Jagtap as 99% of Hindus are in favour of a unified India irrespective of what religion you belong to.

Double Standard..The 21st Century Traitors by mash on 21 Nov 2008

Sympathies for the dead. Violence is inhuman. Some questions:1) What’s the need of MCOCA if there are evidences?2) why not have a quick trial and instead of denying basic human right to the accused.3) Why ATS is using media to condemn the accused before completing justice?4) What is ATS agenda?5) When are you going to apply the same set of rules to jihadis and the D-gang supporters in the Maharashtra police and assembly?Looks lie a re-run of pre-independence era when efforts were made to appease the Muslims to agree to a single country. Now, it is an attempt to steal the vote bank from the like minded morons. People learn from mistakes; In India we glorify mistakes and rationalise to point of absurdities. We all know why India was divided and why one country became secular and the other didn't. It is the RELIGION; Muslim embraces universal brotherhood that’s against the concept of nationhood. You can’t solve the terrorism riddle unless your sort out the religion.

double standards by t k kidwai on 21 Nov 2008

Double standards are ethics of political and communal class. When Muslims are tortured in prison cells, tried under MOCOCA these self-styled humanists do not open their mouths.this is double standard

M for Malegaon, M for Mehrauli, M for Modassa and M for Modi by StLouis on 21 Nov 2008

No wonder that all these blasts that happened in the recent time are handiwork of these hindutva fascists forces. The blasts in Mehrauli, Malegaon and Modassa (All begin with M, also M goes with Modi) were well planned by these terrorists. They wanted to kill two birds with one stone, first they wanted to kill as many muslims as they can and then pretending that it was done by muslims only. They are cowards, if they are really doing it for hindu cause then come in front of the people and the government and take the responsibilities of the balsts.

Excellent eye-opener - IE please take this Up by Excellent on 21 Nov 2008

Excellent eye-opener - IE please take this Up, there seems to be definite link between all these blasts just to malign Muslim Community like how Natturam Ghodse Did in past. I request IE to takes this up and see if this could help for futher blasts which happend around including Samjauta Express.

Malegaon Blast by GEETA PANDEY on 21 Nov 2008

Terrorists don't have any religion. Be it Hindu or Muslim, they should be dealt with same severity. Those, who killed Mahatma Gandhi, Indira Gandhi, and Rajiv Gandhi were not muslims. Common! you call yourself Nationalist by destablising the country?

Terrorists by Raj Kumar on 21 Nov 2008

What about the killing of thousands of Hindus since the medivalists jahils from India's western frontiers took over. And if you think that's old hat, think of the poor Hindu victims in Srinagar valley, Jogeshwari, Godhra and numerous other places. Please don't try to confuse others.

stop spreading hatred by Saccha Gujarati on 21 Nov 2008

I totally agree with you ms. pandey. Terrorism has no religion, terrorist is a terrorist and should be dealt with iron fist irrespective of religion. Let it be amar/akbar/anthony or parmeet. The law should be same and punishment should be the same.

Advani's support for a terrorist is surprising! by Juzer on 21 Nov 2008

Will it be surprising if a terrorist files a false affidavit? Advani shoud know that terrorists are anti social elements, and are hiding behind a religion. No religion teaches intolerance and violence.

discourage beggars and religious minded by vijai on 21 Nov 2008

These kind of secular institutions must be enhanced, terrorism of any type should be demolished. communal thoughts must be thrown away and secular nature to be maintained throughout the nation. every one must understand that this is not religious state.

is Manmohan and other pseudoseculars loosing sleep now? by Vasudevan Nair on 21 Nov 2008

Hello secular thugs.. remember when Australia arrested that Jihadi because his phone was found at London bombing sight, how you behaved? How ManMohan lost his sleep? Now if a bike (stolen?) is used in a blast you put a sadhvi on MCCOA and object if her supporters question the motives? Looks like this is the end of road for secular traitors. Finally Hindus may control their own destiny like Jews are doing in Israel! Shame on missionary/ISI funded english media!

SECULAR THUGS Vs by NUFRIENDZS on 21 Nov 2008

Lame excuse by Indian on 21 Nov 2008

Stolen bike??? Hats off to your creativity!!! This is something which even sadhvi or any of his group members could not come up with!!! My dear friend, sadhvi has been telling that she SOLD the bike and not that it was stolen. If it was stolen, which police station has the complaint registered with? Common, don't give lame excuses. Let her come out clean from the court.

INDIAN INTELLIGENCE ONE OF THE BEST UNDER FAIR CONDITIONS by M.M.NAAZIM on 20 Nov 2008

EDITOR SIR , CONTRARY TO POPULAR BELIEF OUR COUNTRY's INTELLIGENCE SYSTEM , POLICE FORCE IS ONE OF THE BEST IN THE WORLD , BUT MOSTLY THEY ARE UNDER PRESSURE FROM HIGHER AUTHORITIES HINDERING THEIR WORK EFFICIENCY . WHEN THIS PRESSURE IS REMOVED , THE RESULT IS WHAT WE HAVE SEEN IN "MALEGAON EPISODE " , TRANSPARENT - FASTER - EFFICIENT HANDLING OF THIS SENSITIVE CASE . WITH MCOCA SLAPPED -- FULL MARKS AND KUDOS TO ATS TEAMNOW , ATS SHOULD SIMILARLY PROBE ALL OTHER BLASTS TO FIND OUT THE CONNECTION OF REAL CULPRITS BEHIND EVERY BLASTS AND EXPOSE THEM TO THE HILT . AT LEAST WE WILL COME TO KNOW WHICH TERROR GROUP WAS INVOLVED . MUSLIMS OR HINDUS ( SANGH PARIWAR ). MCOCA OR SUCH STRINGENT LAWS SHOULD BE SLAPPED IN ALL CASES. PLAY A FAIR GAME .WITH ONLY ONE MOTIVE , - TO RID OUR COUNTRY OF THIS TERROR MENACE . .

Indian Police by Jai Singh on 21 Nov 2008

Mr. NazimThat means you support the arrest of muslims held in connection with Batla House shoot-out in Delhi and that they be dealt in the same way as Mr. Purohit. Right. Why is that Jamia Milia Islamia paying for the defence of those terrorists?
