Mandarmoni: HC asks state, hotel owners to file affidavits

Kolkata, February 1 The Division Bench of Chief Justice S S Nijjar and Justice Pinaki Chandra Ghosh of the Calcutta High Court on Friday directed the West Bengal Government and the hotel owners at Mandarmoni in East Midnapore, to file affidavits within two weeks regarding illegal constructions coming up at the sea beach.

On Friday, state Advocate General Bolai Roy admitted before the Division Bench that the sea beach at Mandarmoni was damaged due to illegal construction of hotels and resorts.

He further said that the local panchayat and the administration had allowed several hotels and resorts to come up on the beach.

The state advocate general, however, assured the Division Bench that the West Bengal Government has decided to take action according to the provisions of law against hotel owners at Mandarmoni.

In 1991, Coastal Regulatory Zone Authority under the Centre, had issued a notification stating that hotels and any kind of construction was prohibited within specified areas from the sea shore.

Following the notification, on February 2007, West Bengal Pollution Control Board (WBPCB) had asked eight hotel owners of Mandarmoni to demolish their constructions.

The owners had filed a petition in the Calcutta High Court, challenging the order.

The Division Bench of the Hon'ble High Court had asked the pollution control board on the very first day of hearing to file an affidavit regarding the jurisdiction of enforcing a order of demolition by the PCB. This order is nearly one year back. Till now PCB or Govt. is silent. It could be assumed that they have no legal answer to justify the demolition order.
