New Delhi, December 6: The Election Commission on Thursday rapped Gujarat Chief Minister Narendra Modi's justification of the killing of Sohrabuddin Sheikh and held prima facie that his remarks amounted to indulging in activities which could aggravate communal hatred and tension.

Serving a notice to Modi, the EC has asked him to give his reply by Saturday morning.

"The Commission, prima facie, is of the view that the references to late Sohrabuddin and linking his name to terrorism, made in the speech, amounts to indulging in activity which may aggravate existing differences, creating mutual hatred and causing tension between different communities," the EC said.

The Commission said his speech would involve violations of the Model Code of Conduct which bars any party or candidate from indulging in any activity which might aggravate hatred and tension between different castes and communities, religious or linguistic.

"There shall be no appeal to caste or communal feelings for securing votes," the EC said quoting the Model Code of Conduct.

The notice was issued after the full Commission headed by Chief Election Commissioner N Gopalaswamy considered the various inputs and the complaint and has viewed the video recording of the speech, the EC said.

The EC told the Chief Minister that his campaign speech at Mangrol on December four has come to its notice and a complaint has also been filed by Teesta Setalvad alleging that the speech amounted to an open exhortation to violence and misuse of religion for political ends.

In the public meeting, Modi had said Sohrabuddin had got what he deserved.

Sonia provoked me, says Modi

Kapalvad, Gujarat, December.6:

After his hard line talk sparked an outrage, Gujarat Chief Minister Narendra Modi said the Congress president Sonia Gandhi provoked him to rake up Hindutva during the poll campaign and asserted that ‘he was and will be a law abiding citizen’.

Modi also said it is his democratic duty to tell the truth to people and asserted that hostile reactions to his statements on Sohrabuddin reeked of ‘pseudo secularism’.

"I will reply to whatever issues the Congress raises and will speak in the same language and I have a right to defend himself," Modi told a TV channel onboard his specially customised vehicle in the midst of his campaign for the two-phase elections.

Modi said his poll agenda was only to raise developmental issues but was compelled to play the Hindutva card when Sonia called him ‘Merchant of death’.

The Chief Minister's justification of the Sohrabuddin fake enconter killing had provoked angry condemnations from the Left and the Congress and social activists amid demands that Modi be booked for his controversial utterances.

Modi said there was no issue about police encounters but what needed to be debated is the issue of ‘fake police encounters’.

"I do not justify fake police encounters," he added.

DEAR DR. MODI by DILIP on 06 Dec 2007

OH MR. MODI ! YOU ARE BECOMING LIKE SOME OF IE READERS, SOMETIMES CALLING OTHER READERS AS MUSLIMS SHOWING HINDU NAMES WHEN THEY DON’T LIKE YOUR ACTIONS. ANYWAY, IF SONIA PROVOKED YOU, YOU CAN NOT ACCEPT RESPONSIBILITY OF A MURDER. (IN THIS MURDER, HUSBAND AND WIFE WERE SEPARATED WHILE THEY WERE TRAVELING IN A TRAIN. WIFE WAS RAPED AND MURDERED BY POLICE AND EVIDENCES WERE DESTROYED (ANOTHER CRIME HERE IN USA).IF YOUR MATURE ENOUGH, YOU DON’T ACCEPT THIS RESPONSIBILITY, NO MATTER, IF WE AGREE WITH YOU THAT SONIA PROVOKED YOU. PROBABLY SHE DID SO THAT YOU SPIT POT THE TRUTH. LET’S SEE WHETHER YOUR ADMISSION TO THIS CRIME HELPS FBI IN THE SUPREME TO SEND YOU BEHIND BARS. (HOPEFULLY FOR LIFE).

Modui must appel to H.C. to redress this gross interference. by DILIP /France on 06 Dec 2007

E.C.Commissioner is a Congress poodle and wellchreographed snake charmer, who dances to the Congress's tune. This is a cheap politically motivated facade. It is quite sureal for the Big White Mama to abuse and call names to Modi, and get away with it, and as soon as Modi fights his corner with FACTS and TRUTHS, then all shook up. This is farce and grotesque. What Modi said must not be taken out of context. What Modi merely stated that there must not double standards practices in Indian polity, because it sets dangerous precedent. How can a TERRORIST and an extremeist gun runner, who is hell bent on committing henious crime against HUMANITY, be conferred higher judicial status than a law abiding and a decent Hindu. This is outrageous and the E.C. is transgressing his damn remit. Modi has as much right as the Mrs.Gandhi to express his point of view. Modi must immediately challenge this barmy and crass interference, by E.C., in HIGHEST COURT OF THE LAND. pUPPETTERS WILL NOT BE ALLOWED TO RIDE ROUGH SHODS,OVER CONSTITUTIONAL RIGHTS.

Sonia wants to divide the country by Jyoti on 06 Dec 2007

Sonia wants to divide the country. She intentionaly takes the stand to protect the socalled minorities while under the cover of secularism. All along she knows the the majority is right. She is a foreign agent.

My view by Venkat on 06 Dec 2007

I think the EC should be purged of pro-Congress, pro-jihadi elements. It's open bias against Hindu majority is disgusting. Are they telling that talking about terrorism invites communal charges? If so, whenever the next BJP comes to power, they should explicitly pass a legislation barring EC from dictating what and what not be dabated during elections. Terrorism is a issue facing the nation and political leaders have any right to debate it in public rallies, as guaranteed under the constitution. Some low life Congress chamchas in EC sitting and deciding on this issue is just outrageous.

Notice of EC to Modi by s.p.singal on 06 Dec 2007

Modi's statement needs to be viewed in the context of Sonia Gandhi's diatribe against him. She fired the first salvo mischievously raising the communal bogey. Modi had the right to reply to put record straight. Is it not a fact that purely for dirty political reasons the Congress led UPA Government is not carrying out the judgement of the Supreme Court in the case of Afzal Guru? Is it difficult to imagine who is shielding and thereby encouraging terrorist? The Election Commission should stop the game of selective persecution.

Praise for Modi Speech and Actions by Sridhar on 06 Dec 2007

The issue about Sohrabuddin was first initialy raised by the Congress Chair Person at an election Rally. Hence if EC has to issue a show cause Notice then the same has to be applied against the Chair person as well. EC cant be biased as law is equal for every one. Mr. Modi had done a great job for devlopment of Gujart and as on today being Ranked as best Cheif Minister. Thereby he desevers a new term for the benefit of the state. Jai hind

Modi sells hate, murder and hindutva. by khan sahab on 06 Dec 2007

Nobody is in doubt about Modi's intent, and corruption. Corruption with money is one thing, while corruption with human values is another. Modi has sold fairy tales of Ram to let hindutva bridage quench its thirst of blood. Perhaps now Kali mata will be happy... ... or consitution will prevail.

EC issues notice to Modi over Sohrabuddin comments by A.Mahadevan on 06 Dec 2007

First The Election Commission should issue notice The UPA and its Left allies to justify their inapt actions to end the covert and criminal activities of ISI agent Sohrabuddin against the country. Why have they (UPA-Left alliance) not taken tough actions against the Pakistani regime which is sheltering the vicious terrorist Dawood Ibrahim? What about the murders in Nandigram committed by the terrorists from B’desh and the communist government of West Bengal? The Election Commission should take serious note in dealing with Mr. Modi that he has to deal firmly with the agents of Death from Pakistan which is the centre of international terrorism and also it is a country threatening the continued existence of the country as an independent sovereign nation. The very foundation of the country is being persistently attacked from within the country by Islamabad’s stealthy networks.

Narendra Modi's Dictatorship by S.N.Iyer on 06 Dec 2007

This kind of incitement is seditious and amounts a direct flouting of the oath to uphold the Constitution apart from being a contempt of court on a subjudice matter before the Supreme Court. The law should take its course and he should be debarred from standing for any election.Let us show the world that our Election Commission has teeth and upholds our democratic traditions.
