With no alternative left, Yadav, 57, moved the court. Now, the court has reprimanded the two sons and ordered them not to interfere with her possession and get out of the house immediately.
“Both sons are restrained from dispossessing and causing any disturbance in possession of the complainant. They are also directed to remove themselves from the shared household as soon as possible as they have no legal right in the house,” Metropolitan Magistrate Anuradha Shukla Bhardwaj said. The magistrate also condemned the physical cruelty meted out by Deepak and Sunil on their mother.
As per Yadav’s complaint, moved through counsel N K Singh Bhadauria, her sons started ill-treating her soon after the death of her husband three years ago and refused to acknowledge the fact that she was the owner of the house in Shahdara. They allegedly wanted to sell the house, worth Rs 1 crore, even as she did not desire that, the complaint said.
However, things didn’t turn ugly till they allegedly threw her out and threatened her with dire consequences if she entered the house. Despite that, Yadav, with her daughter’s support, went to the house on April 8. But once inside, she was allegedly beaten by the duo and their wives, and later confined to a room.
Yadav was later rescued by the police, which refused to lodge an FIR, prompting the old woman to knock the doors of the court, the complaint under the Domestic Violence Act stated. Accepting her plea, the magistrate struck down the sons' argument that it was a merely a property dispute and further noted that their father had also debarred the duo from any right in the property.
“Under the given circumstances, I am satisfied that the complainant is suffering at the hands of the respondents and deserves protection under the Act,” the magistrate held. To ensure that the complainant was not disturbed after the ruling, the court directed the Shahdara SHO to provide protection to her in case of violation of its order.
