The petitioner had invested in a scheme floated by Himachal Roadways Transport Corporation -’Own your vehicle scheme’. An individual had to provide a vehicle along with a driver to Himachal corporation who in return would pay the owner of the vehicle Rs 9.50 per km, irrelevant to the number of passengers in the vehicle. It is averred that as per the said agreement, the complainant was to provide the bus within a period of two months from the date of agreement. Rajesh had paid Rs 10,000 to the corporation, which would stand forfeited in case Kumar failed to provide the bus within two months.
Rajesh Kumar contacted Swaraj Mazda Limited, Sector 34, in order to get the bus. However, the company failed to provide the bus to Kumar, who then, was refused an extension from the Himachal corporation also. Because of the company’s failure in delivering the bus, Kumar lost his advance of Rs 10,000 as well.
Forum I, while deciding the case, said the complainant was an unemployed youth. He wanted to purchase the bus for the purpose of employment and the same was spoiled by both companies. Hence the Forum directed the motor firm to compensate the youth, along with Rs 5,000 as litigation costs.
