Mumbai attacks: Police file 11,000 page chargesheet

Mumbai Wrapping up its first phase of probe in the 26/11 strike, Mumbai Police today filed a voluminous chargesheet against the lone captured terrorist Ajmal Kasab and 37 others, a majority of whom were Pakistani nationals including two suspected Armymen who are all still wanted.

All the 38 persons that included two Indian nationals--Fahim Ansari and Sabbauddin-- were named in the 11,280-page chargesheet for crimes ranging from waging war against the country to murders.

Among them only Kasab, Ansari and Sabbauddin were arrested while the remaining 35 including Yosuf Muzzamil, Zaki-ur Rehman Lakhvi, Zarar Shah, Abu Hamza and Khapa and two persons with army designations were named in the chargesheet presented before Metropolitan Magistrate M J Mirza. Kasab was not in the court due to security reasons.

Special Public Prosecutor Ujjwal Nikkam informed the judge in the jam-packed court room that some of the wanted accused have been arrested by the Pakistan's Federal Investigation Agency (FIA) recently in connection with the 26/11 attack. The chargesheet makes no mention of Pakistan's intelligence agency ISI.

The Magistrate will commit the case to the Sessions Court on March nine after which trial will begin in a special court set-up inside the high security Arthur road Jail, Nikkam said. Judge M L Tahilyani will preside over the trial. Nikkam said the trial is hoped to be concluded in three to six months.

"Whether the two ranked men belong to Pakistan army or Lashker-e-Taiba is yet to be investigated," Joint Police Commissioner Rakesh Maria told reporters.

A total of 2,002 people including FBI officials have been named as witness in the terror strikes in which 183 people were killed.

According to the chargesheet, the group of 10 terrorists, who carried out the attack on Mumbai on November 26, were selected out of a group of 32. They were given training by LeT commanders in Pakistan for a period of over a year.

The terrorists, of which nine were killed in standoff with security forces during the siege, were trained in use of weapons, GPS systems and navigation through sea route, it said, while elaborating how Lashkar constituted the group besides other details including the training that the terrorists underwent in Pakistan prior to the attacks.

The two suspected Army men, who figured in the list of the 35 wanted accused from Pakistan in the 26/11 chargesheet, were named as Major General Saab and Colonel R Saadat Ullah.

The other wanted Pakistanis mentioned in chargesheet included Mohammad Sayed, Abu Al Kama, Karak Singh, Mohammad Ishfaq, Javid Iqbal, Sajid Iftekar, Kuram Shahbad, Abu Abdur Rehman, and Hakim Saheb, all LeT operatives. The bulky document has also named the nine terrorists who had been killed in the standoff with security forces during the nearly three-day siege. Nikam said the chargesheet contains transcripts of telephonic conversations between the terrorists and their handlers in Pakistan during the nearly three-day siege. The 38 accused have been charged under various Sections of IPC, including waging war against the nation, murder and criminal conspiracy.

According to the chargesheet, the attack by terrorists on November 26 killed civilians from India, UK, USA, Israel and other countries.

Government as well as private property totally valued at approximately Rs 41.72 crore (excluding the Taj Mahal Hotel) was damaged.

Besides, four sailors from the 'M.V. Kuber' trawler were also mercilessly killed by the co-conspirators in pursuance of the criminal conspiracy hatched in Pakistan.

The terrorists targeted and attacked iconic targets in the city of Mumbai which is the Financial Capital of India. These attacks were nothing but an offshoot of the programmed and undeclared proxy war against India by terrorist organisations and their support agencies, it said.

These attacks were carried out simultaneously by multiple teams on locations where the citizens of Mumbai as well as foreign nationals move around.

These attacks were launched through indiscriminate and random firing from deadly AK-47 assault rifles and by lobbing lethal hand grenades. Not satisfied with this mindless bloodshed, the terrorists planted IEDs (RDX based) out of which two were placed in taxis in which the terrorists had travelled to the targeted sites.

The ingress of the terrorists into the city of Mumbai is conclusive proof of the meticulous preparation, planning and training, the chargesheet said.

Congress just fooling people of India since General Elections are nearing. Congress don't have Guts to punish Terrorists. They are afraid they may not get Minority Votes. These are the real Criminals. No need for Chargesheet, Everybody knows that who is the culprit. Just hang them without any further action. No need for any mercy to such people. Congress donot have guts to do this. There is no surprise, even if Congress give tickets for Qasad and Afzal in forthcoming Election

May I ask why only 11,000 page charge sheet against Kasab. Why not a few thousand pages more. Lets waste some more time in all this farce of a court case. I am amazed at the way India works. This case should be dealt with by Indian Army and NOT Mumbai police ( who by the way had .303 rifles during the attack to defend Mumbai). Kasab should have a Guantanamo style interrogation and then executed. Which Indian on earth is interested in the outcome of the criminal proceedings. We have already listened to the actual live phone calls during the Mumbai attack. This is like rubbing salt on the deep and painful wound of the Mumbaikar's. And suppose the court case concludes that ISI and the Pakistan establishment was involved in the terror attack do we really beleive that Pakistan will hand over the criminals to India, NEVER in a thousand years. India is a sitting duck and never had courage to harm its enemy. Our PM has lost the opportunity to strike Pakistan immediatly then.

It doesn't matter whether the Govt. files a 10000 page chargesheet or 1000000 page chargesheet. Who are they going to charge. Pakistan is never going to admit anything. It'll just keep on asking more questions and more questions. I would suggest that the Supreme Court should issue a Show Cause notice to all the media outlets which brodcast the crime live, thereby giving minute by minute updates to the original planners. Can the Hon'ble Supreme Court do that. Or the media will cry freedom of speech and blah blah blah,,What a shame

What is the use of this, if:-Congress is adamant in continuing to deal with this case under soft ordinary laws, and not using POTA-like MCOCA? And, that is just because the terrorists are from the religion it wants to appease even at the cost of the nation? (It is the same Congress which has unleashed the POTA-like Act against a Hindu sadhvi who was not anywhere near the scene of crime, and who was totally unrelated religious woman)-What use is this chargesheet, if, after ten years of ardous work, when the final death sentence is given to the horrible terrorist, Congress/Sonia/Pratibha protect the terrorist (just like in the case of Afzal)?All this is to appease one religion, at the cost of the majority religion..The only way out of this atrocity on Mother India is for all right-thinking persons to vote out Congress, Communists, Lalu, DMK, and all other anti-national parties..
