NCB opposes Fardeen’s discharge application

Mumbai, January 10 The Narcotics Control Bureau (NCB) on Thursday opposed the discharge application filed by actor Fardeen Khan, accused in a 2001 narcotics case, saying that it is a “misconceived application”.

Fardeen has filed an application for framing of charge only for attempting to buy small quantity of cocaine in 2001. In the same application, he also sought discharge from the charge of conspiracy, which will make him liable for peddling 9 grams of cocaine, said his lawyer Ayaz Khan.

Special Public Prosecutor, Usha Sisodiya, today argued in the special court that “there is no scope for arguments of framing of charges” in a discharge application. She also argued that since the accused “himself has admitted an offence, the application is not tenable.” In her written submissions, she stated that “on the basis of these procedural anomalies, this is a misconceived application and hence is liable to be dismissed.”

On May 5, 2001, Khan was arrested by the Narcotics Control Bureau (NCB) in his car while he was allegedly buying cocaine from accused drug peddler Nasir Shah on Juhu Tara Road.
