NHRC gives clean chit to Delhi police in Batla encounter case

New Delhi National Human Rights Commission on Wednesday gave clean chit to Delhi police in Batla House encounter case.

"We are clearly of the opinion that having regard to the material placed before us, it cannot be said that there has been any violation of human rights by action of the police", the NHRC said in its 30 page report on the encounter in September last year.

The action taken by police in which two persons died "is fully protected by law," said the NHRC.

NHRC today filed its enquiry report before the Delhi High Court in a sealed cover. A Bench headed by Chief Justice A P Shah took the report on record and asked the Commission to put the contents of the report on NHRC's website.

The court also directed the Commission to give copy of the report to an NGO on whose plea it had directed the enquiry.

The High Court had on May 21 asked the NHRC to complete within two months its enquiry into the controversial encounter in which two suspected Indian Mujahideen terrorists and a police officer were killed.

Encounter specialist Delhi Police Inspector M C Sharma was killed during the police action against suspected terrorists on September 19, 2008 in the aftermath of serial blasts in Batla House locality in the national capital.

The court had directed the enquiry on a plea of the NGO, Act Now For Harmony and Democracy, that questioned the police version of the encounter.

Two suspected Indian Mujahideen terrorists who were killed were identified as Atif Amin and Mohd Sajid. Two other IM suspects Mohd Saif and Zeeshan were arrested from the Batla House area.

The incident took place a week after serial blasts rocked the capital killing 26 people and injuring 13 others.

Its shame and disgusting finding the NHRC report on Batla House Encounter.Indeed, the NHRC is itself violating very human rights of deprived classes.It has prepared the report on the basis of story presented by Delhi Police only.The Commission could not bother to hear the civil rights group and even the family members of the accused and killed boys were never heard by the so called custodian of Human Rights of citizens of the country.Its is shame that a body which is supposed to act in the interest of the human rights , pronounces that an encounter did not involve human rights violation. While preparing the report in bureaucratic manner , the NHRC might forgot that Delhi Police is infamous when human rights violations of the citizens are concerned.The government must take initiative to hand over the case to CBI.

Well.. i am deeply disappointed to see some of the muslims guys talking hatred here. I just dont understand why you guys cannot for a moment forget your religion and think like any other Indian. There are 100's of hindu's/ christians who get arrested or shot by police and none of them say that its because of their religion. You guys have obviously not lived abroad. Look at how muslim countries treat non muslims and you will thank that you are in India. And you should thank your creator that you are not in china , because then they would have already had one bullet in your head and one in your heart and charged the cost of these bullets to your family. I am not sure what is your definition when you say that muslims are loosing trust. Do not generalize the entire population of Muslims, just because you have been blinded by some burnt out ideaology or some facts that you did not consider. As an indian muslim I am proud of all the things that make us who we are. The government, the police and above all the law and the courts. The country has done far more than other countries have done to their own muslims. I am stating this because I have lived in over 5 different countries.No doubt there are crooks, crooks are everywhere and they would take advantage of every situation to make it to their own advantage, whether communal or not. There are hundreds of people who are Hindus,Christians,Sikhs,Buddist and every other religion under the sun, are arrested by the police.
