New Delhi Just days after supporting the anti-terror measures in Parliament, chief ministers of various NDA constituents expressed their reservations over the new National Investigation Agency saying it would "disturb" the federal set-up of the country and sought tougher laws. The NDA parties, however, said they will support the Centre in its fight against terror.

Speaking at the Conference of Chief Ministers on Internal Security in New Delhi, BJP leader and Gujarat Chief Minister Narendra Modi said, "By setting up the National Investigation Agency, the Central government now obviously wants to take over upon itself the responsibility of fighting terror by sidetracking the states." He said the NIA has become a matter of "mazak" (joke) since it would take at least a month for the government to decide "which and what case to take up" once NIA starts functioning.

Bihar Chief Minister Nitish Kumar, who belongs to JD-U, said consultations with states should have preceded enactment of the National Investigation Agency Act and other anti-terror laws. He wanted that NIA be barred from taking up any case not relating to terrorism without the consent of the state government.

"It appears the recent spurt in terrorist activities has led the Centre to rush through various legislations without adequate consultation with state governments," he said.

"The anti-terror measures taken by Union Government after the Mumbai attacks were encroachment on state's right and were against the federal structure of the country." He said that there are many lacunae in the NIA Act and "states could have also been involved in the decision process before enactment of the Act."

Why? Modi wants his own POTA? Why police should be in the State List? To arrest and herass the oponents? I want this NIA need NOT only be a National Investigation Agency, It should be National Internal Security Authority(NISA), like the defence foreces who are defending the national from the external threats. This NISA should protect the nation from internal distrubances and threats like at Mumbai. The Police under the State Governments should be handed over to NISA and protect the state as it is required. Then only the real Policng of the country will take place in the internal security of the country.NO INTERFERENCES OF THE STATE GOVERNMENT OF THE DAY.

What ever happened to CBI? It could have been easily entrusted with national responsibility and can investigate along with State agencies,which it is already doing, instead of creating another bureaucracy. It seems answer to any problem including terrorism as far as government is concerned is to create another department. Perhaps they should also have department of home work since many kids are not doing their home work now a days being busy watching TV.

How is NIA going to be different from CBI ? If NIA will look at only terrorism cases and CBI other crimes, then are we going to have several more such agencies ? one for tackling terrorism using RDX, one for terrorism with hijacking, one for terrrorism with kidnapping, etc ?Ridiculous. At the bottom of it, NIA will draw its staff from CBI only, then where is the need for another agency, thus weakening efforts by CBI ?Such incompetencies only can be expected from incompetent rulers and party !!

Mr Modi is right in raising relevant issues before India goes red faced with poorly though out NIA. There is risk it would act as a Gestapo preying on Indians for political reasons. The structure and the chain of command with resources has to be clearly defined. If Mr Modi has raised the concerns they should be addressed. It should not be a blanket yes like it happenned with US where no one could question the evidence against Saddam and let US get mired into Iraq conflict while it should have been in Pakistan.It is not that India does not have agencies. It is the bottlenecks within these agencies and poor coordination that makes the effort a waste.Lastly what is the point of all these agencies if the culprits are not punished but made into state guests for the fear of offending certain groups.There should be a mechanism of swift justice.

UPA hasn't allowed strong anti-terror law passed by Gujrat Assembly with 2/3 majority for the last 4-5 years! All to please pro-terrorist muslim voters. That should explain why still terrorists with the indirect backing of UPA, ISI etc. are able to plant bombs in Gujarat. UPA undid POTA and only when they smell a possible Hindu -backlash, they are pretending to act on terror. I am sure even these terror laws will be withdrawn once UPA comes back to power and find no hindu- backlash as in recent Delhi elections. National interest is secondary to vote bank politics for all politicians who talk about 'secularism' 'minority welfare' and 'minority grivences' etc. Hindus, please look at Pakistani Hindus fate, all young Hindu girls are being abducted and converted after forced marriage or sold to Saudi sheiks. And they are brothers of Indian muslims.. so be preperad to suffer if UPA continues to misrule India. Remember Hindu population in Pak went down from 15% to 0.25% where as Muslim population in India went up from 6% to 15% now. Bangladesh no different than Pak. case! What prevents Indian muslims from doing the same as their blood relatives in Pak. or Bangla did if they can? No 'secularist' has an honest answer for this.

Indeed, after remaining inactive for more than four and a half years, the UPA government has rushed through a slew of measures without even a token consultation with the state governments. These are issues that need to be evolved out of a broad consensus. In view of the urgency, the government should have sought to accelerate the process, but sadly the process of consultation itself did not occur - that is definetly a source of grievance for the state governments. The government has ample scope to introduce such acts even when the Parliament is not session. At least now, the central government should sit down, understand the grievances and evolve proper amendments to the laws. Also there are complaints that many sections are rather vague, these lacunae have to be remedied.
