Pronouncing the sentence, Special CBI judge Rama Jain held the crimes committed by 55-year-old Pandher and 38-year-old Koli to be the ‘rarest of rare’ deserving capital punishment. Pandher broke into tears while Koli remained unmoved.
While Khalid Khan, the counsel of the victim's family, called the verdict a "slap on the face of the CBI" which had given a clean chit to Pandher, the businessman's son Karandeep Singh said his father was innocent and he would appeal against the judgement in the Allahabad High Court.
In a statement, the CBI said it was satisfied with the judgement pronounced against Koli but further action in Pandher's case, if any, would be taken only after examining the judgement and on the basis of legal advice.
The court had on Thursday convicted Pandher and Koli under various sections of the Indian Penal Code for murder, rape, criminal conspiracy and destruction of evidence.
"No more penalty could be awarded to the accused persons otherwise they deserve more punishment as their act of murder and rape in this particular case was beyond all the canons of humanity," the judge said.
During final arguments, the CBI counsel had argued that Koli had no right to live in society because even today he had no remorse. "He continues to be a threat to the society," the CBI counsel said, pointing out that Koli was a rare combination of a person indulging in paedophilia (having sex with children) and necrophilia (having sex with the dead) and there was no chance of his becoming reformed and rehabilitated.
Reacting to the court verdict which had not taken into account the CBI's contention that Pandher was away in Australia along with his wife when Rimpa was raped and murdered in February 2005, the CBI said in a release that the opinion formed by it in all the 16 cases in Nithari was based on legally admissible evidence and the result of probe.
CBI investigations revealed that Pandher, owner of the house, was away when the incidents took place. "This is borne out from the documents, statement of witnesses and mobile phone records."
"When the first incident of abduction, rape and murder of Rimpa Haldar took place on February 8, 2005, Pandher was out of the country in Australia. The opinion formed by the CBI in all the 16 cases was based on legally admissible evidence and result of investigation," CBI said in the release.
The CBI said in 16 out of the 19 chargesheets filed so far, Pandher had been made accused in one case relating to a girl Payal, who used to visit his place in Nithari. The CBI, on the basis of the result of the investigation, has chargesheeted Pandher for offence of immoral trafficking, bribery and giving gifts to police officers to save himself and his reputation, it said.

This is patently unfair and against tradition. From time immemorial, whenever a master has committed a crime, the servant has always taken the responsibility for it. In turn the master has ensured that the servant's family was looked after. If it was a murder, the servant went to jail. If the master had got a girl from a low-class family pregnant, the servant married her (it?). Of course, in such cases, the master always had the droit de seigneur. This was how the fabric of society was held together. Willing and trusting servant, caring master. The CBI understood this. making Surinder Koli into a monster that we see only in horror movies. He could have very well got away on an insanity charge. Paedophiliacs having a taste for grown-up women are very rare, though. The judge does not understand all this, must be young and inexperienced. There is always an appeal - for the master.
While most of people would welcome the judgemnent, it opens for debate very important issue on the role of CBI. CBI maintains till last there is no evidence to implicate Moninder Singh but the Judge in her own discretion decided to hold him equally guilty. What would be role of CBI or any other prosecuting agency before court of law in future? This must be agitating not only the minds of lawyers but also common man seeking justice from courts.
and that 1984 carnage was the rareest of rare and Tytler and others are enjoying all the power in Delhi while thousands of Innocent Indian Men Women and children were burnt alive on the streets of same Delhi for over 3 days.
Judgement was from court of justice n not fm court of law.I stand up n salute the judgewho has over rules CBI'S finding and given correct judgement.Request High court to attend this on War footings.So that such criminals can be removed fm our civilised society.
Great! Skewer the rogues. But, but, hang on! these rascals will now appeal to the High Court, then the Supreme Court. So, i can't see them hanging in the next 20 yrs. By then Pandher will have died a natural death, hopefully.
no punishment for Tytler, sajan etc? why? where is justice for poor victim's families? especially when criminals were politicians under guidance and protection from "politicians"?
Justice has been served. But someone needs to look into how CBI gave a clean chit and was there any underhand dealing. The convicts indulged in blatant abuse and slaugher of hapless individuals. They should be hanged publicly
Now CBI should investigate and punish culprits for 1984 carnage? How about Tytler and sajan and other congress leaders who were instrumental in getting thousands of innocents, burnt alive in Delhi in 1984? DO they have immnunity from law being Indian "State Actors"?
This decision has been alloted in the court of law, i feel judges must have seen something fishy at least before passing a capital punishment , it has been said that this case has take a 'rich verses poor' sort of note , i would say yes it did see our CBI is still on the criminal side, Who knows the servant was just fallowing the orders

Dont rely on this punishment , our judicial system is not weak but very weak because in coming days you will see pandhers punishment reduced to lfe time imprisonment and only koli will hanged because pandher is rich and koli is poor .The fact is that in India always poors are hanged not rich ones.
I agree with Hari, everyone who is shouting for the death of Pandhar should not ignore that a clean chit was given to him by CBI. Also how can anyone decide if he is the culprit without being a witness to his crimes just based on media allegations? UP Police like is also as corrupt as any other law enforcement agencies as even arrested terrorists have escaped from their custody.
You can justify theft at times, you can even justify murder at times.. but you cannot justify these kind of atrocities that are worse than murder and solely driven by uncontrollable lust. These duo deserve the death penalty. Hang these duo high as soon as possible!

Given the gravity if the crime, Pandher and Kohli deserved more than death penalty.
Every one seems to be ignoring the fact that Pandher, in spite of given a clean chit has been punished. That is based on evidence provided by U.P. Police. Are we saying U.P. Police is better than CBI ? Pandher an innocent is being hanged and everyone is rejoicing
Yes Up police or police from Timbakhtoo is better than CBI if it is able to get the real culpriy punished. Another guy that needs to be caught and punished is Arushi Talwar's father Rajesh Talwar who has similarly bribed CBI to be let off.
Given the background of Arushi's father, would you think he is capable of bribing his way out ?
The role of the C.B.I to give a clean chit to Pander should be probed and the amount of money this animal Pander has bribed the C.B.I to get a clean chit should also be probed and action initiated against the officers in C.B.I who were dealing in this case.
Justice done - they deserved it more - there is no room for miscarriage of justice -
though justice delayed is justice denied, we need to be satisfied with that fact that at least justice prevails in our country.
Why not death penalty to CBI guys who deified Pandher?They had given him a clean chit, and the nation knows why. Now that the truth is out, CBI guys too should charg esheeted for collusion while taking fat pay check from the government.
There is only one guy in the CBI - Mr Arun Kumar who handles such cases. He handled the Todi case and declared them innocent. Then he moved on to Pandher's case and declared him innocent. And most recently, after lot of drama about doing an honest, rigorous investiagtion he declared Rajesh Talwar innocent in the Arushi murder case. You can draw your own judgements about this esteemed gentleman from CBI. if tomorrow you have a problem, you know whom to contact to be let off. Of course you should have lots of cash to spend.
Hope this will set an example that no one can escape after committing such heinous crimes.
