Justice V K Tahilramani adjourned the hearing till October 24. The judge also allowed the petitioners Endemol India (production house) to make others involved in the show parties to the petition.
Sunil Ahire, President of Mumbai Youth Congress, last week filed an FIR against producers of the show, its director, and participants including Rahul Mahajan (late BJP leader Pramod Mahajan's son), Payal Rohatgi and Sambhavana Seth on the ground that the show was 'obscene'.
Endemol, the producer company, has now moved the High Court, seeking that FIR be quashed.
Among other things, petition alleges that "it was no coincidence" that Ahire belongs to Congress, of which Sanjay Nirupam is also a member.
Nirupam was eliminated from the show after the first week.
Petition also claims that show is not obscene, but competitors of the channel Colors (which airs it) are creating ‘hype about obscenity’.
