Notices to Punjab on PIL protesting reinstatement of convicted staff

Chandigarh, February 1 The Punjab and Haryana High Court issued notices to the Punjab government against reinstatement of convicted Naib Tehsildar and Kanungo. A special Division Bench of the HC, comprising Chief Justice and Justice Mahesh Grover, today issued notices to State of Punjab, the Financial Commissioner, Revenue, Punjab, and two convicted employees, namely Prem Lata (Naib Tehsildar, Mohali) and Kulwinder Singh (Kanungo, Balerkhanpur (Distt Kapurthala), Punjab for March 23rd on a PIL filed by an advocate H C Arora.

The petitioner, on the basis of information received under RTI Act, submitted in the PIL that Prem Lata, Naib Tehsildar, was convicted in a corruption case by the court at Patiala, and was sentenced to two years’ imprisonment, and was dismissed from service by the Commissioner, Patiala Division, but the Financial Commissioner, Revenue, Punjab had later reinstated her in service.

The reasons given behind the reinstatement was that her family condition was adverse; the sentence imposed upon her was also not justified, and that her appeal against conviction was pending in the High Court. Subsequently, one Kanungo Kulwinder Singh, who was dismissed from service (convicted for corruption charges, and was sentenced to five years imprisonment) had filed a departmental appeal, which was also dismissed. He later on filed a review before the Commissioner, Jallandhar Division, in which he stated that his conviction was also not justified; his family condition was very bad; his appeal against conviction was pending in the High Court; and that the other employee convicted on corruption charges had also been reinstated.

The petitioner contended that the afore mentioned employees, having been removed from service on charges of corruption, could not have been reinstated in service, as they have not been acquitted in their appeals, which are still pending in the HC.
