The Supreme Court on Friday vacated the Calcutta High Court order staying implementation of 27 per cent quota for OBCs in post graduate courses including in IIMs.

"We cannot allow Calcutta High Court order to operate," a Bench headed by Chief Justice K G Balakrishnan said.

"Can Calcutta High Court sit over the order of the Supreme Court," the Bench asked while vacating the stay.

The Bench said that when the apex court had upheld the validity of the act providing the OBC quota, where was the question of High Court staying its implementation.

However, the court said, subject to the final outcome of the matter before it, all admissions will be provisional in post graduate courses in Central educational institutions under the Act.

The Court stayed all proceedings relating to OBC quota that are pending in the High Courts of Delhi, Calcutta and Bombay.

It also issued notice to those petitioners who were opposing the implementation of government memorandum in different high courts on the Centre's petition seeking transfer of those matters to the apex court.

Dismiss the castiest judge by Suresh on 17 May 2008

"Can Calcutta High Court sit over the order of the Supreme Court" asked the Supreme court. The Culcutta high court judge had insulted the Supreme court by staying the OBC quota implementation which was previously cleared by Supreme court. This judge was dancing to the tune of upper caste anti-reservationists.This castiest judge should be dismissed immediately.

Job reservations and quotas----- by romesh.sharma on 17 May 2008

In the fields of education, jobs and intellectual arena of human life reservations based on castes or classes is malevolent act of depriving the really deserving. An absolute injustice. With such gestures/overtures or say moves the Law-makers have seriously retrograded the slow but steady progress of socalled SC/ST/OBCs.They were in constant process of realizing their worth and getting to know the spirit of competition through which they could not only obtain higher education but pride and recognisation. Those who criticize caste sytem are frogs in a well because this is the plaines fact of human nature which exists everywhere on the earth in form of class-system,which is more dividing and abominable. If the Govt wishes, sincerely,to help uplift the socalled backward communities it has to rewrite constitution. The Govt has make people proud of their profession and inculcate with the idea of equality and oneness without refering to the caste or origin. Its a system and noway discriminating.

OBC QUOTAS by SUNNY on 17 May 2008

It is pity that people like Satya not able to realize the importance of some affirmative action to bring the socalled OBCs into main stream of Indian society. The descrimination and powerplay continued for the apst 5000 years by elite calstes which form only 15% of Indian population but control 80% of all the jobs in India can not be changed overnight. It takes another 1000 years atleast befor this castiesm is wiped out from the face of India and each child is give equal exposure and oppertunity to come-up based on what they are rather than who (which caste!) they are! Those who do not advocate affirmative action for SCs ,STs and OBCs are perpetuators of descrimination and caste system which is divisive force in Indian socity. It is the time all the OBCs get what they deserve till they have resources and equal exposure to compete with all forward castes

I am an OBC and I REJECT any caste base reservation for OBCs by Satya on 16 May 2008

I am an OBC and I with full sincerity and consciousness declare that I along with my whole family REJECT any caste base reservation for OBCs from government of India or from any state government of India. Who is Arjun Singh to give me reservation, if I don't want any. I also appeal to all members of OBC to reject it for the wider interest of Indian society. Any position or status is superficial, if one has not groomed enough his / her personality, in other words, if one is not competent enough. With reservation, one never becomes bigger, but position itself becomes smaller. Let's live with self-esteem. Or we Indian horses simply not capable enough to move by ourselves after 1000 years in bondage? Sonia and his pet Arjun Singh is not deceiving we OBCs but to his own Rajput community too, just in order to remain in power and loot India. After looting enough, both Sonia and Arjun will fled India.
