Mumbai, March 26 Municipal Commissioner Jairaj Phatak and Metropolitan Commissioner Ratnakar Gaikwad on Wednesday personally assured the Bombay High Court that all encroachments on P D’Mello road would be cleared by May 31.

“They have assured that all eligible encroachers will be rehabilitated,” said Assistant Government Pleader Niranjan Pandit. Earlier this month, the court had stated that it won’t tolerate civic bodies playing with the court’s orders and had summoned the commissioners, to explain the non-implementation of its orders.

A division bench of Justice S A Bobde and Justice Anoop Mohta was hearing a suo motu Public Interest Litigation based on a letter written by retired HC judges P S Patankar and M S Rane, who reside in Rishab Towers at Sewri, on the problem of encroachments along the arterial road.

In February 2007, the MMRDA had informed the court that they would rehabilitate eligible slum-dwellers on P D’Mello road by May. The MMRDA, which surveyed the road for its road widening project, had found that it had been encroached upon by more than 1,000 shanties. Of those, 632 families were found eligible for rehabilitation.
