In his petition, Thakur stated that Advocate N K Nanda had already filed a petition in the High Court seeking the same directions. The petitioner was disposed of by the High Court with directions to the authorities to appoint more assistant public prosecutors in the district courts.
Thakur has alleged that despite directions from the High Court, no more appointment of prosecutors has been made.
Presently in UT District Courts, there is one Chief Judicial Magistrate (CJM) and one ACJM and 10 Judicial Magistrates (First Class). Moreover, nine assistant public prosecutors are posted in the district courts. Out of the nine who have been deputed in the courts of additional sessions court, one assistant public prosecutor is posted at the Consumer Forum.
For 12 courts, there are only six assistant public prosecutors. “On every working day, approximately 15 to 20 state trials are fixed before one JMIC. On an average, one assistant public prosecutor has to attend the trials of two courts. Hence, one assistant public prosecutor is required to conduct about 10 to 15 trials daily. Due to the shortage, FIRs are pending. The assistant public prosecutors are always required in district courts so that state cases are properly attended,” the petition states.
