President rejects CEC advice, Navin Chawla stays

New Delhi The UPA government on Sunday rejected Chief Election Commissioner (CEC) N Gopalaswami’s recommendation for the removal of Navin Chawla as Election Commissioner. A statement issued by Rashtrapati Bhavan said President Pratibha Patil has accepted the government’s advice to reject the CEC’s report. Chawla is tipped to take over as CEC when current incumbent Gopalaswami demits office on April 20.

With Chawla back in Delhi on Sunday evening after a two-day break, the three-member poll panel will meet on Monday to decide the dates of the Lok Sabha elections. The EC completed the all-round consultation process on Thursday. Three deputy election commissioners, doing the bulk of planning and groundwork, were busy brainstorming at Nirvachan Sadan till late on Sunday. The final proposal will be evaluated by the three Commissioners on Monday.

EC sources said the announcement on poll dates could come on Monday itself. A top source said: “We will announce the election dates within a couple of hours of approving the final schedule. The band for announcing the schedule will not, however, stretch beyond Wednesday.”

Rashtrapati Bhavan spokesperson Archana Dutta said, “The President, after careful consideration of the report of the CEC, the government’s recommendation, constitutional provisions and the Supreme Court judgement, arrived at a considered opinion, and has accepted the recommendation of the government.”

The government had recommended that the “CEC’s report and the recommendation to remove Navin Chawla from the post of Election Commissioner may be rejected”.

Gopalaswami wrote to the President in January recommending Chawla’s removal for his alleged biased conduct. The President forwarded the letter to the Prime Minister’s Office (PMO), which, after obtaining the law ministry’s view on the issue last week, informed the President that Chawla would not be removed.

The BJP, which has long maintained that “Chawla is close to the Congress,” expressed its displeasure. “A political decision has been taken on a Constitutional matter. The citizens also have right to know the details of the CEC letter which is supposed to be a remark on the conduct of Election Commissioner Navin Chawla,” BJP spokesperson Prakash Javadekar said. EC authorities refused to react to the development.

Congress should be allowed to appoint all Supreme court judges, Election Commissioners, Vigilance Comissioners, President, Speakers of both houses. Police commissioners of all states, chiefs of all PSUs. This will help us creating a great nation of Gandhi Nehru Family. We can have Indira Gandhi Supreme court, Rajiv Gandhi Election Commission etc. Jai ho.

This was expected. The current President of India was a member of the congress party and her name was recommended by the Congress-led UPA in preference to a second term for the non-political and eminent personality, Dr. A.P.J.Abdul Kalaam for the post. So, it was only natural that Mrs. Pratibha Patil had to abide by the UPA dictats in return for the favour.In view of the allegations against Mr. Chawla, the government should have transferred him to some other position where impartiality does not matter much and appoint another person who can be trusted to be completely unbiased, say a retired SC judge, to maintain the credibility and impartiality of the EC, irrespective of whether the CEC's observations were right or wrong.

It must be noted that the BJP also failed to support Dr. Kalam. I believe this was very calculative move by Congress to tip election results in thier favour by recommending a partisan President and now a world be CEC.BJP failed to see this early on. Now the very core of democracy is challenged.

President's decision is on expected lines. In our constitution president has to work on the advise of the Govt , though some limited discretionary powers are vested in him. It is also beyond imagination that why the election commissioner N Gopalaswami recommended the removal of election commissioner Navin Chawla when the former was about to retire.In our country everything is done on political lines. When the removal of Mr.chawla was initiated by BJP on the ground that he was close to Congress , how it could have been expected that a congress led Govt. at center wouldl advise the president in favour of oppositions demand. This could have not been done even if the BJP led Govt. had been in power and Congress in opposition should have introduced such a move.Under the constitutional provisions, an election commissioner can only be removed by the process of impeachment , this was well known to the BJP members also. The whole issue appears nothing more than a political drama.

right from the beginning of its tenure, this congress government is interfered in those that are out of the purview of governing issues like film board!(in anupam kher case), in educational institutions by changing their heads, now that are influencing Election commission, whose main purpose is to uphold the democracy by conduction un-biased elections!!? their initial claim in such interferences is that BJP ideology was defeated even though they got less than 25% of all votes!? now what is their pretext in influencing Election commission? does our constitution has anything to protect the system of Election commission from political influence?if not, how can democracy can be uphold if that in power uses elections for its advantage?

Every like minded sensible citizen do understand what govt means about the decision to put Mr.Chawla as new CEC.In fact president should have reffered the issue to SUPREME COURT than giving her inferance by taking the congres govt recommendation to put Mr. Chawla in the saddle as CEC.It is sad example for the country to have such govt and cheating the voters. Its a sign of the times that even being only one of the coalition partners, albeit a dominant one, Congress is fiddling with the neutrality of the election machinery by propping a tainted prospect. It shows their desperation, as otherwise those politicans are unelectable without a little support from the umpire (forget about the country-you only remember it when travelling on an international flight).This time after Chawlaji is elected to CEC, you can call the CEC truly by the name: Chief Election Commissioner- (on commission from the ruling party!)

It is well known fact that Election Commission of India is still an independent its nature of function? Constitutionally it is well written. Regarding Chawla's case, political views are highlighted than its constitutional spirit.Chief Election Commissioner has the right to project his/her opinion against his/her colleagues, but at the same time both the executive and legislature also has to evaluate this.But the ultimate solution is that the interference of Judiciary as custodian of the laws of the land. So, we need Election Commission without any internal disputes. If it is so, people will loss their faith in elections. It is most dangerous for our democratic principles as India still stands one among the countries of world. We should respect our democracy and its norms, which are in our constitution, the values of the land.
