In its report filed before the High Court, the CBI said G N Patil and two others -- Ulhas Patil and Ramesh Choudhary (Congress leaders in Jalgaon) -- have refused undergo lie detection test.
The agency, however, gave a clean chit to G N Patil saying that there was no evidence of his involvement in the conspiracy to murder Vishram Patil, former president of Jalgaon district Congress.
He was murdered on September 21, 2005 and his wife -- Rajni -- had moved the High Court in 2007, saying that CBI has not probed the alleged role of G N Patil.
Giving reasons as to why G N Patil was not found involved in the murder, the CBI found as not admissible, claims made by Raju Sonawane, an accused chargesheeted by the agency, implicating Patil and two others to have allegedly conspired with Raju Mali, another accused, to eliminate Vishram Patil.
Eyewitness Rambhau Gobru Pawar had named G N Patil, Ulhas Patil and Ramesh Choudhary but the CBI claimed the same could not be corroborated and hence was dismissed.
Sonawane, a chargesheeted accused, had pointed out at a house where the conspiracy had taken place. The building was that of Dr Ulhas Patil's hospital but the staff of there denied that he had ever visited the place.
"The evidence mentioned do not inspire confidence and credibility. Therefore, there is no evidence of involvement of G N Patil in the conspiracy. Similarly, there is no evidence of involvement Ulhas Patil, Ramesh Choudhury and anybody else in the conspiracy though there may be inter-se political difference or dispute," the CBI said in its report.
The Bombay High Court last week deferred hearing in the murder case till December 3.
The CBI had filed a chargesheet on October six, 2008 against Raju Mali, Raju Sonawane, Leeladhar Narkhede and Dasmodar Lokhande and had stated that they had not found any evidence linking Patil with the case.
Vishram's widow Rajni alleged involvement of G N Patil for conspiring with others to murder her husband on account of rivalry within Jalgaon district Congress.

What he has done is correct. If he tells that he was involved in the murder then it is difficult for Congress and our President. CBI has also accepted to avoid the future consequences. SATYA MEVE JAYATE. But poor Sadhwi Pragya and Purohit are not related to any political leader. Thats why they are subjected to Narco Analysis test again and again. Vande Mataram.

Can someone tell, what the law says. Whether one has right to refuse the polygraphy or narco test or not.
....Then why the hell do they need the President's brother's? Or are laws different for Hindus and Muslims? Rich and Poor? Common man and Politicians?
it is a pity that the CBI is acting based on the whims and fansies of the accused or their facilitators. this way what they can prove, if each person refuses to go lie detection. just because he is brother president, the CBI should not leave him scot free. some countries are even questioning their own president for any violation and why our guys are afraid to touch even the relatives. it should not be that all relatives of PM or President or Ruling Party President can get away with any crime. such soft approach favoritism has lead this country to such a situation. reglious or political leaders will not be arrested fearing reprisal from concerned parties. this approach should be corrected at least now. if you favor each influential people, india will be a haven for criminals. all those who are accused should be subjected to punishment, once proved. otherwise grilling CBI, why they left GT Patil.
So what if eyewitness has named Patil, he is brother of our president, belong to congress party, he can not be murderer. If it would have been some Sadhvi, she would have been torchered, would have had to undergo various tests (narco, lie detector etc) and Media would have pronounced her as murderer. How can Patil be culprit if he is from Congress?
Total manipulation of the case as the accused happens to be the brother of the President of India Shame on the C.B.I Go and hang yourself.
Gosh!! If the CBI's statement that MR.G N Patil is not involved in the conspiracy is correct, then why is that gentleman not coming forward to take the lie-detector test? I think that the CBI is losing its credibility day by day by being supportive of those who are high in the political arena.
And we are told that we have rule of lawin India.. How come all the accused of the Malegaon case are supposed to have smilingly volunteered for the Narco Test, as per ATS' version, only to be tortured mercilessly , as per their own version. The rule of law is obviously meant for the VVIPs and their kin.
