Justice Dipankar Dutta demanded information regarding the person who had first informed the Dum Dum GRP about the body of a 55-year-old man lying on the Patipukur railway tracks. He asked the state government to file an affidavit stating the requisite details.

Rehman’s family has sought further investigation by the CBI to resolve the controversy over the body. The family alleged that the state government is trying to defend the Lalbazar police officers. It has appealed for criminal proceedings against them.

A railway guard of a local train had informed the Dum Dum GRP about body of a 55-year-old person lying beside the railway tracks at Patipukur on September 21, 2007. Advocate Kalyan Banerjee, the counsel of the Rehman family contended how Rehman’s (29) body was determined by the GRP officials to be of a person of 55 years of age. “It was not clear whether Rizwanur’s body was actually recovered from Patipukur. If the CBI report had not dealt with the matter properly then the court should direct the agency for further investigation,” he argued.

Banerjee alleged that state Advocate General Bolai Roy has defended the five police officials during his arguments on the CBI investigation. Roy had also challenged the legality of the CBI investigation.

Notably, Prasun Mukherjee, the former commissioner of Kolkata police, had admitted in the affidavit that he was aware of the marriage between Rehman and Priyanka and he should have directed DC (DD) and DC (HQ) to protect the couple. Instead, Lalbazar police officer had illegaly intervened in their married life.
