Ruchika case: Rathore sentenced to 1 1/2 years in jail

Chandigarh A sessions court on Tuesday enhanced the sentence of former Haryana DGP SPS Rathore from six months to one-and-a-half years prison term for molesting 14-year-old Ruchika Girhotra 20 years back following which the disgraced top policeman was arrested by the CBI.

Pronouncing the verdict in a packed court room, Additional District and Sessions Judge Gurbir Singh dismissed the appeal filed by 68-year-old Rathore challenging the six months jail term awarded earlier.

The judge allowed the pleas of CBI and Ruchika's family for enhancement of his sentence.

The court directed that Rathore be taken to the local Burial Jail immediately following dismissal of his appeal and enhancement of the sentence after which he was taken into custody by the CBI.

After the sentencing, Rathore looked grim, his face sans its usual wide grin, but he told reporters, "I will keep smiling".

The former DGP was sentenced to six months' rigorous imprisonment on December 21 last year by CBI Judge J S Sidhu for molesting Ruchika, a budding tennis player, in Panchkula on August 12, 1990.

Three years after the incident, Ruchika committed suicide.

The quantum of sentence had sparked an outrage in the country. Rathore was later stripped of his President's Police Medal.

Rathore had sought setting aside the trial court verdict against him while Ruchika's family and the CBI had pleaded for enhancement of punishment to the maximum of two years provided in the law.

The court directed the jail superintendent to provide proper medical care to Rathore, if required, following an application by his lawyer-wife Abha that he was a heart patient and required care.

The court allowed Rathore's plea for getting himself examined at the cardiac care department of the Post Graduate Institute of Medical Education & Research (PGIMER).

The bigger crime committed by Rathore is the misuse of his power and position. Why is he not charged with this crime? In the western world this is a bigger crime than the molestation. One can't help but to wonder about the Indian judicial system. It took 20 years for the judiciary to wake up and that too because of the media. Judge could not even give the sentence on the day when he should have blaming lack of time. Do the judges in India have long siestas or they never wake up? Why the judiciary does not perform the duties in a timely manner? Why are there so many postponements. In the civilised societies, where the judicial system works, the judges rebuke the lawyers who waste courts time and have the authority black list such lawyers. It looks like the judges, the criminals and the lawyers in India have formed a cartel and rub each others back.

Its a shame that he has gotten off with only 18 months in jail. For the torture that he has brought to Ruchikas' family, he should have made to spend rest of his life in prison.

Every day of the past nearly twenty years must have been an ordeal for ruchika and her family.They trusted in the "Law taking its own course." The ordeal was huge . This was not so for Rathore.At the end of every crime it is the criminal who benefits by the delay in the so called "Rule of law" What lessons we have learnt ?It is the people who believe in law who have to wait for twenty years for the law to take its "Own course"What if they don't? Am I supposed to compulsorily put my faith in judiciary and Rule of law?

Useless is our govt. and useless are our judges! A girl loses her life, a young boy looses his career, a family is put to ransom by a strong armed policeman! and he gets away scot free with just 18 months of imprisonment! Rathore has misused his position and obvious political connections to do maximum damage without mercy to the victims family! A high profile case like this gets 18 months! God only knows what is happening to those cases which are not so open!

The common people get imootional to the verdict of 18 month jail to Mr. Rathor. The fact is 18 month jail would be a special service to DIG Rathor. The dicsiplined police department still consider him as DIG. The girl molestated commited suicide after 3 yrs. is not relevent to the case and the department sympathy would be to Mr. Rathor. How molestation was defined by law? I know rape can be defined and proofs are validated by scientific laws.

MK, if you are not related to the evil ex-DIG--I mean, if you are not his son or something--let me tell you an easy to understand story. It is easy like one, two, three. An NRI accidently caused death of a free roaming hen and offered to pay 100 rupees to the owner. The owner thought for a minute and instead demanded 200 rupees. His argument was that the rooster will die too when it hears hen's demise. The law recognizes it as indirect damages or consequential damages. I know you don't think much of molestation. It is so common in India when you are in a crowded place. When it happens in the garage cum tennis office, it gets real serious. What do you say?

Ruchika commits suicide 2-3 years AFTER the so called molestation !!! She remembers the incident AFTER 3 years..AND the Law remembers the case suddenly after 20 years..this is sheer nonsense.."getting justice" etc etc...people just jump on the band wagon without thinking even once...all the exercise about the whole episode is just sheer NONSENSE...YES media like NDTV take credit...wrongfully..

SHE WAS MADE TO FEEL GUILTY. IN FACT RUCHIKA WAS MADE TO WATCH THE TORTURE OF HER BROTHER BY RATHORE CHAMCHAS. IF IT WASN'T FOR THE MEDIA ATTENTION, RATHORE WOULD HAVE GOT AWAY WITH EVERYTHING. The following points which arise in my mind after this imprisonment of Rathore......... 1. Is 1.5 or 2 years imprisonment is enough ? 2. Ruchika could be an excellent tennis Star for India but we lost her because of Rathore. 3. The family and friends have been harassed for 19 years, who will pay for it ? Has our Judiciary kept all this in mind while sentencing imprisonment to Rathore ? I am sure this imprisonment is not enough and if our judiciary feels that it is up to the mark then I must say that we have very weak Judiciary system.............. because whatever happened to Ruchika and her family and friends is equivalent to "Murder". 19 years, they suffered so much........mentally, physically.

I would have no quarrel with quantum of sentence had it been dispensed soon after the gruesome assault on a child. Knowing what he did to the family for long after his nefarious advances were resented and the amount of time it took for the law to finally bring him to task, he should have been given 18 years to life. Guilty in their conscience, people change once they make mistakes but this evil person considered himself beyond reproach. Wait a minute, how do we know he had not imposed himself on other helpless children to satiate his lust--look at his ugly face! We will never know. But, then, society does not produce too many Aradhanas and parents like Girhotras. Ruchika could have been my child or anybody's child. I wish every righteous police personnel across the nation gives it a thought and ask if it was worth protecting this evil person and keep him out of jail for this long. Another family member closer to law, Abha should have personally seen that he was adequately punished.

"Satyameva Jayate" has been proved here. India - The land of several hundred gods, proved time and again, that Justice may be delayed, but Truth always triumps. My heart felt sympathies to Ruchika's family members who had to undergo the torture at the hand of a civil "Servant". The DGP is more demeaning than "Filth" is what he needs to understand (similingly as puts it) during his stay at Prison.

Sorry this is no punishment. It should be remembered that the person in question is a former DGP, he should have been given exemplary punishment so that no other government or police officer dare to do what Rathore did. In this case, he has been let off lightly. Plus he will have a comfortable time in Jail as Rathore's police brethren will ensure comforts for him. Judiciary needs to come down hard on such characters who are criminals in uniform so are more dangerous than ordinary criminals.

Finally we could see the verdict just. Let this case become a precedent to caution any violators of law who molest innocent ladies and children. Our judicial exponents should reinvent harsh rules to offer severe punishment to molestors and rapists. The punishment meted out to Rathore is very minimum. Had a similar crime been committed by an ordinary criminal, the punishment would have been severe. Here the crime has been committed by a police officer whose duty is to save the lives of people. Hence the punishment for him should have been atleast double, so that it serves as a deterrant for other erring or trying to err officials in power.

Late Ruchika's parents tried there best from pillar to post for justice in this tragic incident that shocked the Nation and the charges against Mr S.P.S. Rathore former DGP Haryana were proved and he was sentenced to Six months prison , But the family of Ruchika appealed for strict punishment for Rathore and the court has announced its verdict by exceeding the sentence enhancing to 18 months . The judgement in this case proves that No body is above Law and Law is above all to safe guard the interests of the common man even though who so ever What ever post or status he enjoys in the society .

The whole nation knows and agrees that punishment should be a lot more than there mere few months. And whats the delay in making the amendments in the law book for the same. The judge should have taken into consideration that Rathore was a Top Cop - IPS and his job was to protect Ruchika and not treat her in such a manner. His punishment should 3 times that prescribed by law so that it is an example to other law enforcing officers that they will be detered from taking law into their own hands. The law should be changed that if any Police official, how ever high or low, will be awarded three times the sentence for any crime committed by them. Then the police men will not break the rules of the land.

Lock him up and throw away the keys. 18 months for ruining the life of a family is peanuts. If the courts wanted to set an example, he should have been locked away for life. But would they? The judiciary is in collusion with the police and the CBI, otherwise why would the latter seek only 2 yrs for such a bunch of heinous crimes. If this guy was convicted in any other country, he would not see sunlight again. The arrogance in his smile should disappear forever. Kudos to the media and all supporters of Ruchika for putting up a stand against this serial pest.
