Kolkata, March 11 Rukbanur Rehman, brother of Rizwanur, in his reply to the court has pointed to the loopholes in the affidavit filed by the government.

In its affidavit, the state government stated that on September 21, 2007 the driver of the local train reported to Dum Dum GRP at 10:45 am about a body of a 55-year-old lying beside the railway tracks at Patipukur.

To this, Rukbanur in his reply has stated that his deceased brother was around 30 years old. How come a body aged about 55 could be the body of Rizwanur, he argued.

Kalyan Banerjee, counsel of Rukbanur and his mother, said that there was mystery behind it. He further said that the state government has always tried to conceal the role of the police in the case and also tried to cover up the facts of Rizwanur’s death.

Banerjee alleged that there was an understanding between the state government and five police officials with the former trying to protect them.

As a result, the state government claimed that the CBI did not carry out the investigation in accordance with the order passed by the High Court, he said.

Passing the order on CBI probe on October 16, the High Court had then asked the state to file an affidavit within six weeks.

But the state government contended that it would not file an affidavit unless a copy of the CBI report was handed over to it. Finally, Justice Dipankar Dutta directed the state to file an affidavit within a week on February 28.
