“We would consider whether the matter should be referred to the Constitution Bench,” a Bench comprising Justices S B Sinha and V S Sirpurkar said adding that the matter involved an important legal question.
The Bench was hearing a petition filed by a group of women lawyers seeking direction to the Kerala Government to lift the ban on women devotees entering the temple.
The Bench said that it would take the decision after the state government filed its response and granted it two weeks time for it.
The PIL filed by six woman lawyers belonging to Indian Young Lawyers’ Association, contended the custom restricting the entry of women aged between 10 and 50 years into the temple was violative of their constitutional rights, including the right to equality guaranteed under Article 14 of the Constitution.
They also challenged the validity of the provisions of the Kerala Hindu Places of Public Worship (Authorisation of Entry) Rules, 1965 which legalise to the ban.
Terming the practice as a “socio-religious malady”, they expressed “surprise” that the practice was being carried out by a temple board which received Rs eight lakh per annum from the State.

Could the "six woman lawyers belonging to Indian Young Lawyers’ Association" also file another PIL asking the court to intervene in another 'custom' in another Hindu temple in Kerala called 'Naree Pooja', literaaly translate to worhipping women aleging gender discrimination ?
restriction to the entry of women aged between 10 and 50 years into the temple is a issue of religious faith and rituals, there is no role of court in this issue. for example while worshiping the idol, priests used to keep the door of temple closed which is a part of the puja or pray, latter in future court can give rights to everybody to enter inside inner temple even at the time of puja or pray. my advice to every believer is that, who respects SWAMI AYYAPA should respect the rules too, as they were made by SWAMY himself
With due respect, I just wonder, is this not "judicial overreach"?
I agree with the petition that the women have a right to enter the temple and hope the ruling is in there favour. Now that does open a can of worms, does it not ,if the same cannot be applied to mosques ?Well, we will have to wait for a group of women of that faith to get together demanding the right. Interesting......
I certainly understand the concerns. So is Jama Masjid and many palces of worship.Could any women enter a Mosque?-Let them sort this out first. Can any non muslim enter the mosque. That is also covered under the same law.Stop making a fuss, every religious place has a set of rules built within its origin
it a trdition follwed from time immemorial and it has to be followed.no one has authority to interfere in it.the irony is every body wants to interfere in hidu faith is involved.why the same forces do not raise their vice regarding woman's entry in a mosque. Is it called 'secularism".let nobody meddle in the affairs of hindu faith because faith is supreme.
