The restriction would apply to temples, mosques, churches, gurudwaras and places of worship of all other communities, a Bench of Justices Dalveer Bhandari and Mukundakam Sharma said in an interim order.
The Bench said its order would be enforced till the issue relating to construction of places of worship at public places is finally resolved by the apex court.
The apex court also said that the fate of existing places of worship shall be dealt by the respective state governments on a "case to case" basis.
The Bench passed the direction after Solicitor General Gopal Subramanium informed the apex court that the Centre and the states had reached a consensus that there shall be no fresh construction of places of worship at public places.
The apex Court had on July 31 directed the government to ensure no place of worship is allowed to come up by encroaching public place.
The direction to the Centre came during the hearing of a petition challenging the Gujarat High Court order of May, 2006, by which the Municipal corporations in the state were directed to demolish all illegal structures including places of worship on public roads.

The verdict of the SC in this regard has to be welcomed by one and all.But the implementation of the order is again in the hands of politicians. Look at what happened to the SC rulings on bandh supported by State Govts, when Mr MK went on hunger strike in Chennai.Hence SC should give a deadline to the Govts to comply with its order and pull up the Babus if not implemented. Let us all resolve not to encourage such temples when they come up.
The judgement is welcome. Illegal construction of places of worship has nothing to do with actual worship. Genuine worshippers purchase land at market place to construct olaces of worship with donations from devotees. How can God be benevolent to worshippers/ faithfuls if He is made to sit in an illegal place? It is actual a mischief by unscrupulouspeople who want to earn money/wealth playing on the sentiments of innocent/ religious-minded persons. They don't pay for the electricity or water utilised nor do they pay any tax. One of the methods used is to keep idols near a tree for some time to test the ground. If these are not removed, some earthen lamp is lit on selected days. Then the fencing of the tree is done. Crowd develops. Peeple tree is revered It is not uprooted or cut. Even roads/pathways have been encroached as peeple tree is in the middle of the road. Politicians patronise such places for votes. Govt. must relocate existing peeple trees from middleof road/pathways.

Good news for secular India. The construction of workship places must be banned once for all and also the supreme court must come forward for the removal of existing places of worship in public places with in a time frame irrespective of religion. This will be the foundation for peace and security of the divertisied people of india. Let the people built and manage their own worshop places, by this the people will know the value of the place of worship.
Government is for governance. Why does the judiciary have to don the role of government and issue such instructions. 'coz government doesn't govern. For every step of governance, political interest instead of public interest is the deciding factor - what gets done and what doesn't. We have umpteen no. of legislations which are outdated and have no relevance, but they are still live. Parliament has become a chaotic market place for politicians instead of being the place where legislations are conceptualised and born. When parliament is used ineffectively,somebody has to do the job - what is required and is not done by that organ of democracy, which is reponsible for it. But our learned politicians even find fault with that - calling it "judicial activism". The same politicians will shy away thousands of miles before even thinking of such a small matter like this one, which impact public convenience/inconvenience in a great way. Good job, SC - keep it up. At least somebody is awake.
What is someone keeps a rock and puts oil on it, later after few years someone writes article claiming it to be thousands of years old? Then people start building temple claiming the rock's existence for thousand year. (Do we ever scientifially test it?)
The Hon'ble SC of India has handed down people-friendly verdicts time
It is one of the best order of SC. But will it be implemented? Places of worship are more a source of financial and political clout rather than a source of devotion.
This is a great sensible direction from the court. Such constructions are happening thru out India due to several reasons. Besides competition and hatred between the religions, most of the time this happens when people want to stop public or private projects which may seems to acquire their land fully or partially.
What a shame on successive Govts, that what they themselves should have done in the normal course, is being handed down by Supreme Court.Whenever Govt is confronted with a sensitive issue, it tries to hide behind the pallu of Supreme Court.Only Modi seems to be an exception
Apex court always takes correct decisions. how strictly govt implies them is the matter of concern for us.
Use of noisy firecrackers in residential places in the name of religious celebration also should be stopped. Such uncivilized traditions are only social nuisance and lame attempts to follow our feudal masters of the past when Rajas, Jaminders used to celebrate as they like without bothering how others will be affected by their noisy and perverted way of celebration. We must not support a downright wrong and uncivilized ritual in the name of tradition.
The SC order should have also said that the standing illegal places of worship should be demolished. In India, very few know how to spell the word discipline. Discipline, which is universally absent, should be enforced, without exception, in all sectors of life. Without discipline, there can be no order and no progress.
Govt and SC also should think about banning any celebration whether for religious purposes (Puja or Namaj) or private matters (like marriage) blocking public amenities like road. It’s a standard protocol for the rich and powerful to shamelessly block public roads and indulge in medieval mentality of extravagant celebration. India must stop feudal way of life and promote real democracy and secularism.
The Supreme Court is correct and as an extension of its logic I would say public displays of faith should be banned totally as also ALL public functions related to religion. For too long we Indians have had an excessive dose of religion so much so that large sections have forgotten to work and have made fighting for religion their livelihood. That's the formula for peace and prosperity in India. NO public display of articles of faith even on our bodies and NO public processions led by members of ANY religion! Let us see if we are up to it. Religions should be celebrated inside the four walls of our homes or strictly inside designated premises such as temples, mosques, churches, viharaas, gurudwaras etc., no religion in the public domain! Period!
I wish supreme court would ban the loud speakers blaring in places of worship causing disturbance to the neighborhood, at all times of the day
yeah, the place of worship near my place disturbs people 5 times a day.
In the landmark judgment delivered by Honorable Supreme Court of India in Writ Petition (Civil) 72 of 1998 arising out of SLP (C) No. 21851/2003 pertaining to noise pollution, the Honorable Supreme Court has upheld the absolute rights of a citizen of India to enjoy a pleasant life in peace, comfort and quiet within his house and the right to prevent noise as a pollutant reaching him/her. This enlightening judgment is available on the website of Supreme Court of India. The SC has banned use of loud speakers between 10PM to 6AM. but these orders are openly violated every morning at 5AM in mosques for azaan. No government has stopped this practice!
This much awaited judgement must also be enforced at state levels to be effective.Under the garb of religion massive pieces of land have been illegally grabbed, forest areas have been usurped and rivers and water bodies have been polluted. To top it all is the noise pollution of so called worship which has made life for the community a virtual hell round the clock.
In india places of worship mostly constructed in public places to instigate communal tension.Otherwise its a clandestine technique used to grab land in the name of some religious trusts.Lets henceforth not give room for such kind of evil design by miscreant elements.We have enough number of temples,churches, mosques.If we are truely religious, we can experience the spirit of god in all our actions.Lets welcome supreme court's halt on construction of new places of worship.
AFTER A BRIEF SPELL ON THE PRETEXT OF NON INTERFERENCE IN MATTERS RELATING TO LEGISLATURE, THE SUPREME COURT HAS RIGHTLY COME OUT TO BAN CONSTRUTION OF PLACES OF WORSHIP ON PUBLIC LANDS. SUPREME COURTS CORRECTIVE ORDERS IN PUBLIC INTEREST BOOST THE MORALE OF ORDINARY CITIZEN WHO OTHERWISE REMAINS A HAPLESS SPECTATOR TO THE MISDOINGS GOING ON IN THE NAME OF DEMOCRATIC FREEDOM. THANK HEAVENSTHAT JUDGES OF THE APEX COURT ARE REALLY 'MEN OF HONOUR'OTHERWISE WHAT WOULD HAPPEN IN THIS LAW FLOUTING COUNTRY WITH CRIMINALS IN THE LEGISLATURES IS ANY BODY'S GUESS.
We need a million Khairnars. We object to people earning a livelihood by hawking stuff off pavements, we object to people living on them just because they do not have an alternative, why should not we object to these (very lucrative) business enterprises which grow like a million Raktabeejas. We can always boot a hawker off a pavement, we can always throw a family with its pitiful belongings into the road, we might even find the guts to serve a notice (nothing more) on the powerful who encroach on public space as if it came as part of their mother's dower, but a religious establishment in India stays for ever. So such things have to be nipped on the bud, and a clear message given that this does not happen. Businessmen and seasoned criminals normally do not believe in wasting their efforts, so once they know a line of activity in not economically viable, they will stay away from it.
Another feather in the cap of the Supreme Court of India. This will bring about the realization of real progress in the country and will help greatly reduce the effect of religious fundamentalism in this country. Bravo SC!
Very good judgement.This should be made applicable to construction of statues also with immediate effect. Those who want statues may have it in their own land.
Will this judgement apply to Congress and other political parties and their places of worship?
