SC issues contempt notice to Narendra Modi

New Delhi, December 12: The apex court issued a contempt notice against the Gujarat CM for his remarks on Sohrabuddin Sheikh.

Modi, however, has been exempted from personal appearance.

SC's verdict came in despite Govt's appeal for putting off the hearing on account of polls.

SC on Wednesday began the hearing on the pleas seeking to make Gujarat Chief Minister Narendra Modi as a co-accused in the Sohrabuddin Sheikh fake encounter case on the basis of his alleged statement during an election rally justifying the act.

Additional Solicitor General Gopal Subramaniam, who has been assisting the court as amicus curiae in the matter and senior advocate Dushyant Dave, appearing for Sohrabuddin's brother Rubabuddin Sheikh, pressed for issuing notice to Modi for his explanation on the alleged statement.

The ASG said the Chief Minister is accountable to the law and an explanation is called from him for his remarks.

"Nobody should have the courage to publicly speak about the case which is sub-judice and to give justification on it," he said.

The ASG further said in this situation, it is for the court to decide whether the investigation of the case can be handed over to the CBI for upholding the majesty of law.

Seconding the ASG's request for issuing a notice to Modi asking him to justify his consciousness, Dave, counsel for Rubabuddin who is another petitioner in the matter, said the Chief Minister's statement amounted to interference with the process of justice.

"The Chief Minister's statement was greatest and direct affront to the pending proceedings," he said.

Dave also questioned the entire investigation carried by the state police and expressed apprehension that due to the filing of weak charge sheet, the victim's family could not get justice.

He said the Chief Minister had gone eulogising the cold-blooded murder of Sohrabuddin in November, 2005.

Meanwhile, the ASG also placed in sealed cover affidavits of two persons, who claimed to having seen Tulsi Ram Prajapati in police custody a day before he was allegedly killed.

Prajapati was the third person apart from Sohrabuddin and his wife Kausar Bi in a Ahmedbad-bound bus and were later shot dead on November 26 2005 in a fake encounter by Gujarat's Anti-Terrorist Squad.

We know that Supreme court judges are appointed by President who was elected by congress and communists party. Unfortunately Court actions are being seen as not above board due to varying yardsticks for personalities based on their affiliations.Supreme Court has to ensure that there is much more muck that has been allowed to pass earlier and let go many more scot free for much worse crimes. Modi's crime - praising some encounter - fake or otherwise is a matter of judicial review.

Communists openly abuse the courts in W.Bengal. Karunanidhi often talks about Brahmin judges. Sonia often tells the govt. to ignore court orders whenever it feel like doing it. SC never dares to issue contempt againt them but it finds it easy to issue such notices against BJP leaders all the time knowing very well it goes down well with the media. These judges are cowards. They too think it is acceptable to trash Hindu leaders. The whole system stinks and biased against Hindus because every one got to prove he or she is secular in this country without having to worry what secularism means.

Modi may be good to the investors in Gujarat but overall he is a blot. The law of the land is always supreme and SC should take proper action against shameless Modi. It was around a month before there was Poll in Times Of India asking public view about Indian judiciary and system,if they trust it or not.There were eight pages full of comments and I could find only two who were positive.None other had trust of faith in Indian judiciary/justice.All these courts,judges and Atorneys are opportunits and serve the cause of immidiate bosses/ruling Parties.In a democracy everyone has the right to express views and say what and how he/she feels.Its not only CM Modi accountable to the Law but Sonia and Digvijay too.They must be issued notices for contempt and propagating against Modi and his Govt with incendiary speeches and allegations.Mr.ASG says "Nobody should have the courage" which is foolish.Is he threatening Modi or someone else?Why can't one speak publicaly about cases which are sub-judice?Is there any definte clause or Law under constitution which gives freedom of speech?
