The apex court posted the matter for hearing on July 20. The Bench headed by Chief Justice K G Balakrishnan said that any interim order against the High Court verdict, if necessary, will be considered only after hearing the parties concerned.
Notices were also issued to Naz Foundation, the NGO and other respondents who were parties before the High Court. The court was hearing the appeal filed by Suresh Kumar Kaushal, an astrologer, against the July 2 verdict of the High Court.
While mentioning the petition, the counsel, appearing for the astrologer, said that since the High Court verdict, there have been seven cases of gay marriages, and raised several questions, which, he claimed, were likely to affect the institution of marriage.
However, the Bench said, "We have not changed the definition of marriage." During the brief hearing, when the counsel was pointing to what he claimed was the adverse impact of the judgement decriminalising gay sex among the consenting adults, the Bench said the police had not been registering cases in such matters. It said though the law has been in force since 1860, there have been only a handful cases under the penal provision except those of paedophile cases. For "gay sex, to my knowledge, no body has been prosecuted," the Bench, also comprising Justice P Sathasivam, said.
The petition filed by Kaushal sought quashing of July 2 verdict of the High Court legalising gay sex between consenting adults in private, which was earlier a criminal offence punishable with upto life imprisonment. The petition contended that homosexual acts, by all standards, were "unnatural" and could not be permitted. "No one can imagine the consequences of the unnatural acts. Even animals don't indulge in such activities," he said in his petition.
He said the High Court judgement would result in spread of HIV virus as "it has been amply proven" that the infection was contracted through such sexual acts. "We have to look at our own scriptures to seek guidance from them and they are against such behaviour in our society. If such abnormality is permitted, then tomorrow people might seek permission for having sex with animals," he argued.

A law interpretation body that rules its views in light of the prior judgements on a given dispute. Therefore to interfere with ,the Government of India in penal codes' is a sedition,for which the supreme court today stands condemned. Asking the Govt. to clarify its codes,is inexcusable and a national disgrace. Govt. is directed by the Parliament only,not the supreme court. No wonder there is no reply from Govt. of India. A disdain would alone see this 'Gay Agitation" die a natural death.

I think , as a nation if we prioritize our health issues , I dont't think debating about gay issues will come in the first 1000 priorties of the nation. when people are dying of TB, malnutrition, malaria etc etc. To nationally debate about gay right issues is deplorable.I am sure media has taken up this issue from western media as it is the priority for them as they dont have any other basic health issues to discuss. It is not for india to nationally debate. Without debate gay issues has to be solved to save energy and time for our lazy politicians and utilize their time for better health issues. Let us talk,debate and solve important health issues of common citizens of the country first and then lesser important issues.

The System that gave us life has a moral code. All human societies should base their laws on the basis of its moral codes. The violation of natural law cannot be considered a sign human advancementIn the West same sex relationship is becoming prevalent due to the collapse of the family system. In some places the sexual practice start at a tender age, sexual fidelity in married life has disappeared. Two years back the women students of a University demonstrated against the rising cost of anti-pregnancy devices. There students of opposite sex stay together and as a past-time indulgence in sex is what they can do easily. The demonstrators might have been urging for govt. subsidy, but then the economic melt down took place. Sensible people refuse to get associated with such voluptuous bodies, to them same sex relationship seems meaningful. So, what there happens is the reaction of culture.

i think the high court is right in legalizing gay sex, who the hell are we to put restrictions on what is acceptable. if you look closely at some of the depictions in various temples they do not only show man-woman copulation but also same sex. So technically morally it isn't wrong. i think by legalizing it we're leaving a great legacy, and children will know that they are accepted and loved irrespective to their sexual orientation, unless you want your child persecuted because he is different or want him to continuously seek therapy because he isn't accepted by his family first.. then of course don't legalize it.

The choice, here, heritage of CHILDREN or a onslaught on their innocence.Supreme court of India must represent the invisible party to this dispute ,the chidren! who stand exposed to a third unknown beyond their natural parents, carers. Under no rules should SC abrogate this right of children.
Ravi,God has created males, females and eunuchs. I do not udnerstand how you catagorise 'gays' a seprate sex group. Everybody has a right to live, but nobody has a right to live, they way he/she wants. If they are living in a society, they have to follow the rules and regulations of the society, and do and act things which are permitted by that socieity under their culture, custom and civilization.If somebody says it is tehir right to have sextual intercourse with anyone and everyone that cannot be allowed in a civilized society. Consenting two adults may do it in privacy, but it cannot given legal sanction.
I pray to the Media,our leaders, justice and the perverted youth with sexual desires which are not clean and natural ,to at least spare the childern from reading the dirty material daily. This is a remarkable decision by the high court. Homosexuals are human beings just like any of us. Just because their sexual orientation is different does not make them any less human. Accommodating homosexuals in the society is something that our culture has done long back. Heard about the phrase "Tritiya Prakriti"? Bravo high court. Ignorants will raise their eyebrows, cultural terrorists will jump and self appointed custodians of the culture will squirm but hopefully the govt will do the needful to bring out a bill for providing equal rights to these people..

This debate can go as long as one wants it to. It is a matter of belief...But all i am saying is that i want to live my life as anyone else would want to. Why should i keep battling within myself for years and years when i know that i am right. The way i feel cannot be governed by a court verdict or by a law passed by the executive or even by people who claim to be the upholders of "bharatiya sabhyata". As a human i have the right to love...i have the right to live without being called a criminal for loving another being!
The god gave birth not only to man, woman but gays and eununch as well. If we are given full freedom to choose our religion, life partner then why shouldn't it be the same with the gays. They also have the right to live and not just survive under vile living conditions. The west has recognised it, now its our turn. This is high time for us to deciede if we are a society which recognises and accepts the god's creation or keeps the other deprived of the god's own will.
Nonsense! Those who harp of Indian culture as an argument against the HC judgment are usually those who are highly malleable hypocrites who say one thing and do another. Our culture now is crap that encourages neither merit nor introspection. It certainly is not what it used to be when we were the toast of the world with extraordinary riches. Another point to note is countries who are 'culturally' active constitute most of third world where few 'haves' control most of 'haves not'. The issue here has nothing to do with western culture but is that of freedom and individual choice. Some people were born that way and most certainly are not guilty of that.All in all, our 'culture' has neither made us efficient ,nor punctual, dedicated or committed to our causes. Its time to introspect and we desperately need some one like Swami Vivekananda. This is a minor issue and it should have been done and dusted. There are more important things to look after.

It is very shocking that electronic media in India is behaving in a such a stupid manner. Every thing immoral and anti Indian culture is supported by them. It seems all of them only watch, drink, eat and sleep western culture where there is no moral values and no sense of family. Are we trying to convert Indian society into a brothel?? I am sure even if rules are changed by courts or Governments but Indian society at large will not accept such things. We have enough mahatma and Saints guiding Indian people on regular basis so India will never adopt western culture lock, stock and barrel.
