“We set aside the Delhi High Court’s order and direct CBI to hand over the passport to Nanda within a week,” the Bench said.
The Bench held that Nanda’s passport, which has been in CBI’s custody for the last 15 months, was not taken by the investigative agency in accordance with the procedure laid down by law.
However the court said that the CBI can approach the passport authorities to impound the passport in accordance with law.
Nanda’s passport was seized by the agency on October 10, 2006 after a search warrant was issued against him.
The trial court had directed the investigating agency to release his passport which was set aside by the Delhi High Court.
The CBI had alleged that Nanda had received Rs 400 crore from abroad which was not disclosed. If he went abroad, he would not come back, it said and had sought reasonable time to finish the investigation.
