SC refuses to stay circulation of Nanavati report

New Delhi, September 26: The Supreme Court refused to stay the circulation of Justice G T Nanavati report relating to the Godhra carnage in Gujarat. A petition seeking a stay on the report was mentioned before a bench headed by Chief Justice K G Balakrishnan which posted its hearing for October 13.

The NGO, Citizen for Justice and Peace, approached the apex court contending that a report by Justice U C Banerjee Committee on the same carnage has been stayed and a similar step should be taken for the Justice Nanavati Commission report which was tabled in the Gujarat assembly on Thursday.

"There is absolutely no evidence to show that either the Chief Minister or any of the ministers in his council or police officers had played any role in the Godhra incident," said the report of Justice Nanavati, a former Supreme Court judge.

The report, which went into the Sabarmati Express coach burning in February, 2002 that left 58 kar sevaks returning from Ayodhya dead, said it "was a pre-planned conspiracy" hatched at the Aman Guest House in Godhra.

all those doubt nanavati report , shall proceed to Godhra and take first hand account from the staion staff and vendors available on that fateful day. Nanavati have given the documentry proof. if anybody is to question, they should question the proof.in contrast, banerjee commission had concluded in "absence of conclusive proof".the difference lies in approach of digging the truth.

The people very much have a right to know what caused the Godhra carnage aboard a train rake especially since it is said to have triggered mass violence manifold in horror. This information has been documented based on carefully gathering and study of all relevant factors and evidences, by a learned judge duly appointed by the Govt. of Gujarat. The people should not be prevented from accessing this information, regrdless of the release date of the Report which contains it. The Govt. of India, through its rail department, headed by Mr Lalu Prasad Yadav, took upon itself to order a counter report, once having smelt the tenor of the other report. That act itself was malafide. Even while very recently deliberating about a stiff and stern law on terrorism, the Central govt. coalition member parties had diametrically opposite stands, and virtually stalled a really effective law to stem terrorism which has already given a terrible sample to be tasted by Indians thru several bomb blasts.
