New Delhi, May 8: Noted cardiologist P Venugopal was on Thursday set to be reinstated as Director of the prestigious All India Institute of Medical Sciences (AIIMS) by the Supreme Court which struck down a law to ease him out after a bitter row with Health Minister Anbumani Ramadoss.

Venugopal challenged an amendment to the AIIMS Act that fixed the upper age of retirement of Director at 65 years, a step that forced him to him relinquish office.

A bench of Justices Tarun Chatterjee and H S Bedi upheld the appeal filed by Venugopal challenging the impugned law as being discriminatory and malafidely brought to superannuate him.

Venugopal had contended that the amendment was brought with the sole purpose of removing him from his office due to his differences with Ramadoss.

Senior counsel and former Law Minister Arun Jaitley had contended on behalf of Venugopal that the Act was illegal as the High Court had in March last year upheld his continuation in the post and the matter was pending in the apex court. But the Centre in the meantime brought the amendment in Parliament, he said.

The law was enacted after a no-holds barred confrontation between Venugopal and the Health Minister over the control of the prestigious institute.

In effect, the judgement would mean that the Government is now under an obligation to bring back the Director.

"SC verdict has thwarted 'game plan' in Parliament"

Reacting to the verdict, P Venugopal said the striking down the law that resulted in his removal as AIIMS Director has thwarted the "game-plan carried out in Parliament".

"I am happy that the Supreme Court has upheld the truth," Venugopal said.

While Venugopal did not talk to the reporters directly, he conveyed his reaction to them through senior resident doctor Anil Sharma.

"The decision has thwarted the game-plan carried out in Parliament," Sharma said quoting Venugopal, who made no direct reference to Union Health Minister Anbumani Ramadoss with whom he had a bitter row.

The Resident Doctors Association of the hospital, which has been backing Venugopal in his tussle with Ramadoss, maintained that he would back in office as soon as possible.

Corruption Galore by Sonia and Manmohansingh Govt. by Raghvan Ravindran on 08 May 2008

The Cabinet which endorsed the game plan to remove Dr.Venugopal and the advisors of RAMDOSSA whose adviced was acted upon by Ramodossa should be sacked by the Preident under the Constitution for breaching it for malicious and personal motivation and other Unconsttutional purposes. There is no difference in the cases of unconstitutional use of poers by Ramdossa and his party collegue Balloo. All of them are corrupt to the core and breached the oaths of their offices.Shame on these so called leaders and their Sonia.

Unhealthy Minister by enveekayes on 08 May 2008

People like Ramadoss, Balu, Gill,ArjunSingh etc. should resign immediately; alternately the PM should put in his papers without any further delay; the UPA sarkaar in Delhi wants to stay put in power by hook or by crook and to justify the UPA has many efficient spokesmen and women.; Misuse of office and and abuse of authority and that of the whole parliamentary process has been done brazenly; the Supreme Court has put brakes on such dirty games by yet another Union Minister Ambumani. What a great tamashaa is going on in Delhi for some months now;

Woodcutter Ramadoss by Kannan on 08 May 2008

This man, Ramadoss Jr will not quit. His father is affectionately called Woodcutter Ramadoss because he and his goons have chopped off millions of trees in TN. Why should he quit? He has to enjoy the life. The shameless and spineless PM is glued to his seat with all these corrupt scoundrels surrounding him. So why target the poor Health Minister?

Our health minister is a moron by Rajat Sodhi on 08 May 2008

May be its high time for this health minister to get himself along with Arjun Singh psychiatric check up from Dr.Venugopal of AIIMS.Thank god we have Supreme court in India.

Dr. Venugopal please draft letter of resignation for Dr Ramadoss by K. K. GHOSH on 08 May 2008

Congratulations Dr Venugopal, you have won over a ill intentioned and illegal individual, this moment the entire Country knows, his name is Dr Ambumani Ramadoss. The hon'ble Supreme Court has shown great courage and upheld the truth. It is possible in at this moment Dr Ramadoss is not in the right frame of mind to write a letter of resignation, I suggest you to please pay a visit to him, tell him that God is great and Supreme Court is a right representative of God almighty in India today, and than please draft a good letter of resignation for him (Dr Ramadoss. Please take a further trouble please drive down to our Prime Minister and hand over that letter of Dr Ramadoss to him. One time no body had time to see and meet you in Govt. See possibly they will now receive with a fake smile and weak sound of congratulations. ANY WAY THE ENTIRE COUNTRY IS TODAY HAPPY WITH THIS GREAT JUDGEMENT OF SC. May God continue to help you to serve the nation and AIIMS

The Tail and the Dog by Dr N Chandrasekar on 08 May 2008

There is no question that we have the most honest man occupying the PM's chair. But he is also no match for the 30 odd Tamilnad MPs who will bring disrepute to him. The first CM to be subjected to Sarkaria Commission Corruption enquiry was from Tamilnad way back when it was an unknown commodity in India. When we lived in that State we felt these dosages of muscle power. Thanks to Ramdoss, T R Baalu and others of his kind, the whole nation now knows.

SC Strikes by SURYA PRAKASAM on 08 May 2008

sir,Everybody overreached their limits in this case.If only the Government and hospitals bestow equal attention in attending to the real health needs of the common man ,India would be a better place to live-in.Unfortunately our energies are spent in catering to vanities.

SC reinstates Venugopal as AIIMS director by praveen on 08 May 2008

The decisions has once again reinstated a person who is a very good doctor but very bad administrator. It was better for SC that not to interfer in Administrative matters which is proved inefficiency of Venugopal in so many stances like spreading of hattredness in AIIMS.

Shameful... by withheld on 08 May 2008

The question before the court was not about the administration whether or not it was bad/good but the 'administrator' who was shown the door through 'unethical' means, which the SC struck down. There is nothing more to it.

SC reinstates Venugopal as AIIMS director by sushil johar on 08 May 2008

the SC decision vindicates that UPA govt has scant regards for the law of land, personal rivarlies are bigger than good governance, moralities are on lower side,PM has at all no role in policies making

Judicial overreach by venkateswaran on 08 May 2008

In yet another case of judicial overreach SC had struck down a law enacted by parliament a power bestowed on it only to ensure that the laws are in conformity with established constitution. there is nothing unconstitutional about fixing an upper age limit for AIIMS Director which the government did. A recalcitrant Cardiologist had made use of the judiciaryto make a mockery of parliamentary democracy. If Anbumani Ramdass was acting with a vengence. Dr Venugopal's retaliations have also been highly objectionable

AIIMS by Rajaram on 08 May 2008

What will Rum Dose will do now?. He has another year left as a minister.

Insult by Suresh on 08 May 2008

What an insult to the parliament and democracy. Now on, let the courts make laws, instead of parliament wasting its time in making laws, to be struck down later by courts. Also, why people of the country should spend crores on electing members of parliament, if there is no use.

Shameful... by withheld on 08 May 2008

Indeed, the insult has been brought about by good-for-nothing politicians who use their 'responsibility' to settle score with individuals through 'bad' legislation.

Sack Ramadoss by Satish Haldankar on 08 May 2008

It is time that the Prime Minister removes the Health Minister, who has his priorities all wrong. He should have concentrated on the menace of fake medicines, rural health care, improve the standards of health education. Instead he is after soft targets like the film stars and AIMS.
