A Bench headed by Chief Justice K G Balkrishnan issued notice to Sahil Mittal, a resident of Sangrur on whose writ, the High Court had struck down state government's notification permitting the Shiromani Gurudwara Prabandhak Committee (SGPC) to give 50 per cent reservation to Sikh students in colleges run by it.
Punjab government and Shiromani Gurudwara Prabhandhak Committee (SGPC) has filed petitions challenging the High Court's December 17, 2007 verdict.
The High Court had relied upon the census of 2001 according to which the Sikh population in Punjab was 59.2 per cent and Hindus were 37 per cent.
The Court had held that there was no material to substantiate that 'Sikhs' were non-dominant group in the state apprehending the deprivation of their rights at the hands of dominant groups.
The judgement of the High Court was based on an eleven member constitutional bench ruling that minority status can be decided on the basis of state population and not on national basis.

Ofcourse Sikh are minority,you think sikhs have equal oppurtutiny NO.sikh have to work hard in order to do anything in India.Sikhs are always discreminated in there own country so called India.
For more than a century till 1952 in our families the eldest son used to be made a Sikh which means the family has donated their son to the community; who while practicing Sikhism to the true sense will fight for less fortunate in the society and protect Hinduism. When Punjab would be a sovereign independent State then Sikhs are not entitled to be given a minority status otherwise so long the state is a part of India and being ruled ruthlessly ignoring norms and values of administrative justice and the rule of law, Sikhs must be accorded minority status so that their sufferings be heard and paid attention Worldwide. if Sikhs are minority in Punjab, then Hindus should are minority in the world, so Hindus should be given priority everywhere. what about Kashmir and North eastern states where Hindus are minority.This is country ruled by a ALIEN who does vote bank politics by supporting people who keeps bombs in our backyard. Then this alien voices her supports to the people,whose daily job is to roam and converts poor Hindus saying and telling about equal society, where upon conversion they are only allowed in DALIT churches and not in the main one. We hindus are made to be fools by the politicians like this alien, one old crook from the southern state and by the so called communists who are ready to sell India for the welfare of china. I haven't seen a stupid country where the majority leaves as minority. When will we Hindus in India will voice our concerns leaving behind our caste differences? Will the middle east countries/ Malaysia give equal rights to Hindus?
dear mates. the SGPC gets its fair amount of money from the Indian State(as mentioned in a commment already), so Why should education be imparted only on the basis of Relegion mate? I did my schooling in Punjab. if U did as well.. did u NOT saw the phrase going in Punjabi "Vidya wachari tan paropkari"~??Enough said lads... please stop this Bull.(having said that I will still stand on the other genuine hardships faced by our Sikh brothers in the country , to much relief which r decresing (slowly) BUT steadilyGood luck.
Hindus will never get their due credit and will always be suppressed in this country, and will always be forced to live like third class immigrants (not citizens) in their own country. What a joke, Sikhs are minority in Punjab, well then there goes their illegal demand for Khalistan.
In India only second largest majority can claim to be minority. Everyone else is a alien
SC and HC have no right to butt into the sikhs insitutions funded privately. These are not central govt. funded institutions, they have no jursidiciton over privately funded sikhs institutions. The corrupt and biased and jealous SC/HC and GOI are it again.
The institutions in question are not entirely privately run. They have substantial grants from the state government to cover their yearly budget. That being the case, every resident of Punjab should have the same right to enter these institutions. The SGPC is simply a caretaker of the institutions and the religious affiliation of its members should have no say in the running of these educational institutions including admission related decisions.
The whole country is behaving like a joker. Sikhs are minority in Punjab!!!!! The whole country should be declared “backward” and everyone should get reservation.
Why minority status of Sikh's has to be evaluated on state basis. Only in one state of India we have some presence otherwise close to zero.Its a big joke, that sikh started their own institute with their private money, so welfare of sikh community but even in that case we need permission of courts.Every community has right to grow, in its way. And why does people have problem if we are doing that with our own money.
