“The case falls in the rarest of rare category. The depraved acts of the accused call for only one sentence — the death sentence,” said a bench comprising Justices Arjit Pasayat and Mukundakam Sharma.
Earlier, the accused, Bantu, was awarded death sentence by an Agra trial court. On appeal, the Allahabad High Court had also confirmed the sentence.
On October 4, 2003, Bantu had lured the girl, the daughter of his neighbour, to a pond on the pretext of buying her balloons. He had instead raped her. After committing the offence, Bantu inserted a 57-cm-long piece of wood into her private part.
Two villagers, on hearing the victim’s cries, rushed to the site and caught hold of Bantu in a naked condition.
The girl was taken to the hospital where she was pronounced dead on arrival.
The postmortem and medical reports indicated that she suffered injuries on her face and neck.
According to the report, about 33cm of the wood was inside her body and another 24cm protruding from outside.
Bantu, in his defence, alleged that he was implicated by the deceased’s family because of a land dispute.
