Sanjay approaches SC for suspension of conviction

New Delhi Actor Sanjay Dutt filed a petition in the Supreme Court on Thursday seeking suspension of his conviction in connection with the 1993 Mumbai serial blasts to contest the upcoming Lok Sabha polls.

Dutt, who recently joined Samajwadi Party and is the party nominee from Lucknow parliamentary seat, was convicted under the Arms Act and was sentenced to six-year imprisonment. The actor was absolved of the serious offence under the TADA.

Dutt, 50, who was convicted and sentenced to six years imprisonment under the Arms Act for possessing illegal weapons in connection with the blasts case, was granted bail after he filed an appeal against the TADA court's verdict.

While granting bail to the actor on November 27, 2007, the court had directed him to surrender his passport and asked him not to leave the country without its permission.

The Bollywood star, who was sentenced in July 2007, had spent 18 months in jail during the pendency of the trial. The actor had in the first week of February got Supreme Court's permission to extend his foreign visit by two weeks to fulfil his commitments as United Nations' Goodwill Ambassador on malnutrition.

In the case of Bablu rivastav Supreme Court refused and in the Sanjay Dutt case also it is justified for dismisal. If such criminals are allowed to contest and win it will be a mockery of Indian democracy and a shame for honest and patriot citizens. Now only obstacle is court. If court permits he may even win elections by huge margin. He can be made Defense Minister of Union of India and the country will be in safe hands. Gone are the days, when there was morality in politics. In earlier days after Independence, Politicians had some moral values and politics was a mission for them, a few of them are alive. Now it has become a profession . Every political Party wants to encash the popularity of a person to raise their numbers in the parliament or assembly to grab power by hook or crook . Whether the person whom a party ticket is offered is a good man, intellectual , corrupt or has a criminal background is immaterial. winability is the only criteria.There are many members, who had been convicted by lower courts but are members of parliament or ministers, their cases pending in upper courts. Our judiciary has pronounced exemplary decisions in the past and in this case also the Apex Court will give its right verdict. If court allows, Sanjay Dutt also has every right to contest the election and the ball will be in People's court. Let us hope for the best for Sanjay Dutt and the Indian politics.

Now the essential qualifications to become someone an MP or MLA are (1) semi-literate or illiterate, thick skin, criminal background and absence of morality. Even then they are earning much more than a qualified Engineer or Doctor and sometimes even more than a CEO of large Corporate Body.

Sir, without in any manner trying to influence or interfere in the judicial process, one expects the SC not to grant any relief in this case at this juncture for the following reasons: (1) If no permission to contest election is granted nothing will be lost but if permission is granted and later on if the conviction is confirmed the whole election process would be rendered a waste. Since holding of elections cost lot of money we can ill-afford to waste the same. (2) If any urgency is shown in the matter disregarding the other pending cases, it will only mean that even the Judiciary is not serious in stopping the persons with criminal record to enter the electoral fray. If SC declines to grant the relief now no one will hold anything against it. Rather such a decision would service as a precedent for future and criminals would think twice before undertaking criminal ativities. (3) If judiciary cites lack of proper infrastructure, such poor infrastrue should affect politicians also.

Shame for India and judiciary ! If criminals and convicts like Sunjay Dutt allowed to contest who can save India? Is it the India Mahatma Gandhi wanted ? If Sonia or Rahul are really claimants of Gandhi legacy they should convince Sunjay Dutt not to contest . We have enough politicians and Sunjay Dutt can go on acting in films as that is his profession. The main purpose of such people with criminal background entering politics is to get protection against their past wrong-doing.
