Sonia Gandhi's case transferred to division bench of CIC

New Delhi The case pertaining to disclosure of documents relating to Indian citizenship of Sonia Gandhi under the RTI Act will now be decided in a Division Bench of the Central Information Commission.

The move follows a decision of the Chief Information Commissioner to withdraw himself from the case because of his proximity to Gandhi.

Chief Information Commissioner Wajahat Habibullah who was hearing the case decided to transfer it to a Division Bench because of his association with Sonia Gandhi -- he worked as secretary of Rajiv Gandhi Foundation under her Chairmanship.

"The case is therefore transferred to a Division Bench comprising Information Commissioner S N Mishra and M L Sharma for hearing and disposal," Habibullah said.

Exercising his Right to Information, an applicant Milap Choraria sought copy of all documents and file noting from the respective files relating to the application for Indian citizenship submitted by Sonia Gandhi and the approval by Government of India, from Home Ministry.

His application was turned down by the ministry citing a clause of RTI Act, prohibiting disclosure of personal information of a third party which serves no public interest.

But the Ministry provided sketchy information to him saying that Gandhi had applied for citizenship on April 2, 1983 for Indian citizenship and was granted the same on April 30, 1983.

Unsatisfied with the response, Choraria appealed before the CIC to facilitate him in getting the information.

Now I realise why Mr Habibullah and Mr Ansari have not yet been removed inspite of e-mail dated 28-11-2006 from President's Secretariat. CD of telecast on METRONATION ON 29-06-2008 is proof that Mr Ansari availed of hospitality of Indian Oil against whom he was to hear my appeal no CIC/MA/A/2006/00097 for supply of INQUIRY REPORT of Mr Yogesh, Commissioner of Departmental Inquiry, Central Vigilance Commission to me regarding corrution detected by Ministry of Petroleum. It appears that they are being protected by their HIGH CONNECTIONS and NO HEARING is held during last 3 years. This is resulting in the continuance of monthly loss of Rs 99000 to Public Exchequer and to last till the year 2014. This shows how whistle against corruption is crushed in India. It appears no wonder that KASHMIRIES want to be more freed of Indian Babus than any thing else.

Sir,Apart from Sonia's citizenship file Milap should also ask for the protocol between India and Italy ovrer granting og citizen ship to the citizens of other countries. This is because the protocol says that the citizenship to the citizens of the other country shall be subject to the same terms and conditions which our citizens will have to go through while taking citizenship of Italy. This is particularly important because Italian laws clearly debar persons of non Italian origin from occupying any electoral office whether that be the office of an ordinary county member.

I commend Mr Milap Choraria for taking on the courage to ask Ms. Sonia "Bano's" citizenship status and circumstances surrounding the approval of her citizenship. It is a shame that billion plus people don't have guts to question her and equally bad that judiciary and bureaucrats are trying to hide some facts. If there is nothing wrong than why hide. Good work Mr Milap Choraria.

Enough time will be allowed to lapse before a reply which brings no solace to applicant will be forwarded that too if he does not get a reply "FILE IS MISSING'.
