State govt files caveat in apex court

Chandigarh, January 23 Taking no chances in former DGP S S Virk's case, the Punjab government today filed a caveat in the Supreme Court to make sure that he does not get relief from the apex court.

Sources said the former DGP has decided to file a special leave petition (SLP) in the Supreme Court this week. "We have filed the caveat today just to make sure that in a case SLP is filed by Virk, then we are informed about it and can argue the case accordingly," said a law officer.

On January 17, Justice H S Bhalla of the High Court had given a jolt to the Vigilance by disbanding its investigating team constituted to probe the disproportionate assets case registered against Virk. The High Court had also expressed strong resentment over the functioning of the Vigilance in the case and its SSP Surinder Pal Singh. "It is futile to accept that an independent and wholly objective investigation was done by the present investigating team, which is being headed by Surinder Pal Singh. If the investigation is carried on by this team, public will lose faith in the investigation… It is an unfortunate case, which tends to shake the credibility of police investigation and undermines the faith of the common man in the Punjab Police," Justice Bhalla had held in his order.

Notably, the court had also taken exception to the Punjab government's sudden repealing of the Punjab Vigilance Act. "Some top brass senior officers were deputed to the key posts and a special investigating team was formed to investigate the cases against Virk. All this clearly shows that there was malafide intention on part of the government and its instrumentalities in repealing the Vigilance Act. The arrest of Virk also took place in hot haste, as if the team was bent upon arresting him. It is the manner of arrest from which vindictive attitude of the Punjab government is evident," the court had held.
