Subramanian Swamy gets protection against arrest from HC

New Delhi Janata Party chief Subramanian Swamy was on Friday granted interim protection till January 30 by the Delhi High Court against his possible arrest for writing an allegedly “inflammatory” article.

Justice M L Mehta granted interim protection to Swamy on an undertaking by him that he would not write such articles in the future and issued notice to the Delhi Police for its response on Swamy's anticipatory bail plea.

While hearing Swamy's plea, Justice Mehta observed, “We are a secular country and we should respect the system which we have.”

The court said, “It is not a European country like Britain. We have a diversity and we should be proud of it.

“If you (Swamy) give an undertaking that you will not write anything based on the book, I'll grant you the relief,” the judge said.

The court's observation came after Swamy's counsel, senior advocate K T S Tulsi, argued that as he (Swamy) has exposed 2G scam against the government, this case has been lodged to harass him.

The counsel also said Swamy had written the article based on a book, which he had written six years ago, but no untoward incident had happened after that and suddenly the police registered a case against him soon after he exposed the 2G scam.

Swamy had moved the high court yesterday seeking anticipatory bail in the case filed against him by the Crime Branch of Delhi Police for writing an article in a newspaper in July last year which, it said, tended to spread communal enmity.

Swamy, however, has denied all charges levelled by Delhi Police in the FIR. The matter will now come up on January 30.

Going by the comments, looks like some of them hasnt even read that ! He advocated harmony in India by calling muslim to accept their hindu ancestory, which is fact instead of creating rebellion wherever we go ! actually, i am proud of that and see no issues. Removal of mosque - its known fact that mosques were constructed after demolishing hindu temples and till today jobless mongers fuel both sides to make their living. he called to wipe of that completely. Dr Swamy is a statesman who fought for rights for muslims in hasmipura murder case and now fighting for them vellore. only ignorants will rant against him.

Irresponsible inflammatory writing resulting in disharmony and hatred amongst people is unacceptable in a country like India with its diverse population groups. Toughest punishment should be awarded to persons indulging in such acts. It is good the Court made Swamy to give an undertaking that he would not repeat writing such inflammatory articles. Atleast after giving such undertaking, hope Swamy behaves rationally. In the name of freedom of speech, no one has a right to foster hatred and illwill among the different sections of people.

Now Swamy must file a petition in HC for quashing of FIR u/s.482 and get relief from HC as the FIR is premeditated and intentional to create a fera on him and to suppres him.He should also go for filing case of defamation agaisnt PC and DElihi police for 5 crores as stated by him in twitter.
