The petitioner had submitted that although the Shaheed Udham Singh Memorial Bhawan Society could not complete the construction of the memorial due to shortage of funds, yet the administration is duty bound to complete the memorial, instead of resuming the plot which would lead to its demolition. The UT Administration, however, sought adjournment of the case as its counsel was not present at the court.
The memorial society in its reply alleged categorically that in fixing the price of the plot, the administration had not acted fairly. It has been alleged that while Chaudhary Devi Lal Memorial Trust in Sector 28 B, had been allotted land at Rs 1,800 per square yard on July 25, 2002, the land for the martyr’s memorial was allotted at Rs 5,800 per square yard.
Again, when the site of the memorial was shifted to Sector 44 C, the price of the land was further increased. The reply also claimed that although the Member of Parliament had donated Rs 8 lakh from his MPLAD fund in 2007, the UT Administration has not released the amount so far to the society.
It further added that the society has spent Rs 41 lakh so far on the construction of Martyr Udham Singh Memorial, thus the administration should also contribute to the noble cause by reducing the cost of land, rather than attempting to resume it.
