Wife files complaint against man for forcing her to indulge in unnatural sex acts

Ahmedabad, October 2 While the Union Health Minister Anbumani Ramadoss is making all efforts to do away with Section 377 of the IPC in order to decriminalise ‘unnatural’ sex in India, there is a newly married woman in Rajkot, who has used the provisions of the same law to take up her cause before a local court in Ahmedabad.

The 24-year-old woman has accused her husband of depriving her of congenial rights and forcing her to indulge in unnatural sex since marriage. The victim, Shanu Dholakia, who stays with her parents near Lad Society in Vastrapur in Ahmedabad now, has been married to one Mitul Dholakia (29), the son of a prominent Rajkot-based educationist, since January 2007. The Dholakias run a chain of elite schools in Rajkot, police officers investigating the case said.

Incidentally, Shanu was allegedly tortured by her in-laws for not being able to conceive a child for more than a year since marriage.

She filed a complaint before Metropolitan Magistrate J K Pandya of Metropolitan Court no. 5 on September 25 this year, following which the court asked the Karanj police to investigate the matter.

“In her complaint, Shanu has said she has not been able to conceive because her marriage to Mitul has not been consummated. She has also accused Mitul of forcing her to indulge in unnatural sex. We have registered an offence under Section 377 of IPC and are investigating the case,” said Investigating Officer, Karanj Inspector, V D Gohil.

Though Shanu has also accused eight of her other in-laws, including Mitul’s parents of allegedly subjecting her to cruelty for not being able to conceive a child, the court has only asked the Karanj police to investigate the allegations of unnatural acts of sex.

“We will record the couple’s statements and get some medical checks done to ascertain the allegations,” Gohil added.

Mitul is also accused of taking Shanu to a sex club in Thailand during their honeymoon and forcing her to watch sex shows, which were not to her liking.

“She has also alleged that Mitul used to force her to watch movies on unnatural sex,” Gohil said.

The police said that four days before Shanu filed her complaint in the court, Mitul met Shanu near Bhadra temple in Karanj and tried to persuade her to return.

When contacted for comments, a family member of the Dholakias, said, “Mitul is out of town and does not have a mobile phone.”
