Will not allow Balkanisation of India, SC to Raj

New Delhi, February 22: The Supreme Court on Friday took a serious note of the controversial remarks of Maharashtra Navnirman Sena (MNS) chief Raj Thackeray relating to north Indians and warned that Balkanisation of country would not be allowed.

"We can understand what is happening. We will not allow/permit Balkanisation of this country," a Bench headed by Chief Justice K G Balakrishnan said.

Expressing displeasure over Thackeray's statements that allegedly resulted in violence and attacks against north Indians in Mumbai and other parts of Maharashtra, the Bench said "it is a dangerous tendency."

"This is one country and we will not accept son of soil theory," the bench, also comprising Justices R V Ravindran and Markandey Katju, observed.

The bench, however, refused to pass any direction on two PILs relating to the issue saying since the matter primarily relates to law and order situation, it could be brought to the notice of the state government and petitioners could approach the Bombay High Court.

"It is not possible for this court to give a direction on law and order situation," the Bench said and also declined to accept the contention that a direction was required to the Election Commission to derecognise MNS as a political party in view of the statements of Thackeray.

"You have to make a representation before the Election Commission for derecognising a political party. How can this court issue mandamus when you have not gone to the EC," the Bench said.

Balkanisation?? I think the word Talibanisation is more appropriate here.

Balkanisation of India was done a long long time ago by none other than Pundit Jawaharlal Nehru who was awarded Bharat Ratna also.when there are states which have been divided on the basis of language what do you call that.Raj thackeray os a product of the mindset created by the division we all have been subjected to this.Whenever Iused to travel in North india or speak with them I hadd been havin gthis strange feeling that they look down upon me as a south indian .It is in the mind.Sc cannot do anything about this menatl balkanisation

The Supreme Court here is right. The Honourable court will only rule as per the laws passed by the constitution of India. In our constitution every citizen of India has full right to move around and stay/work in any part of India. There is no such thing as sons of the soil in our constitution. We agree that Mumbai with its increasing population is in bad state. There is a shortage of every inch of space and commodities due to population explosion in Mumbai. I agree that it is very difficult to commute in local trains at the peak hour due to overcrowding. But we need to find solutions which is peaceful and acceptable to all the citizens of India. You cannot target taxi drivers and vegetable vendors who are actually taking advantage of the opportunities available in the city of Mumbai. And what Raj Thackerey has done is not what actually he meant to do. He wanted to settle political scores and wanted to hog the limelight so that in the next election his party can won the Maharashtrian votes. However barring Raj Thackrey and his tirades against north indian, We indian hv to find a suitable alternative to stop this migration. We need to develop and progress other states equally as Mumbai. We need to stop the influx of these migrants by creating Industries, jobs in their own state. If the jobs and opportunties are made available I do not think that these migrants workers will come to Mumbai leaving their family behind. For India to progress further we need to have the economic development permeate thru all the states and affect all the denizens of India. Unless we do that there is no stopping of balkanisation of India.

SUPREME COURT JUDGES ARE NOT SUFFERING LIKE WE MUMBAIKAR! LET THEM COME TO MUMABI AND TRAVEL THRU LOCAL TRAIN IN OFFICE TIMING IN 2ND CLASS COMPARTMENT. THIS IS JUST ONE EXAMPLE I AM WRITTEN. my dear friend u say that our constitution is old but let me tell u something.it is because of this constitution and the supreme court that india has survived the test of time.look at our neighbouring countries.they also have their constitution but they are in turmoil.pakistan,sri lanka,bangladesh -all have their constitutions but still their political stabilization is struggling.
