Women police resorting to 3rd degree restrained by HC

Chennai, July 8: Amid allegations that officers of All Women Police Stations in Tamil Nadu were resorting to "third-degree" methods during inquiries on matrimonial disputes, Madras High Court has ordered that the local police officials should obtain permission from SP to effect arrests and set guidelines to be followed in such cases.

Justice R Regupathi, hearing a petition submitted by a person on Monday that he was violently beaten up by a woman police officer in connection with a matrimonial case, observed that "every one expected that all women police stations would be conciliation centres for re-union. But the actual experience divulged that even minor disputes due to family misunderstandings are given colour of a crime."

He said "in fact helpless women are encouraged to come forward with a case with grave allegations against the husband and his family, invariably dragging all family members to police station and subjecting them to ignominy and disgrace."

"There are some instances where arrests are strategically planned to harass the accused and his family so as to make the succumb to the horror of being imprisoned. Such arrests are invariably plotted at the weekend particularly on Fridays so that they cannot even apply for bail for next two days," he said.

The Judge added "there were many reports of married sisters of husbands, even though they are pregnant or with baby in hands, are summoned and brought to the stations in the name for enquiry and ruthlessly harassed."

Justice Regupathi suggested that except in cases of dowry death, suicide and offences of serious nature, the station house officers of All Women Police Stations should register FIR only on approval of the Dowry Prohibition Officer (DPO) concerned.

The Judge said social workers or mediators with experience may be nominated and housed in the same premises of All Women Police Stations along with the DPOs.

Arrest in matrimonial disputes, in particular arrest of aged, infirm, sick persons and minors, shall not be made by the Station House Officers, the Judge said adding that if arrest was necessary during investigation, sanction must be obtained from the Superintendent of Police concerned by forwarding the reasons recorded in writing.

The charge-sheet must be filed within a period of 30 days from the date of registration of the FIR and in case of failure extension of time shall be sought from the jurisdiction magistrate indicating the reasons for the delay.

A different uniform other than the one for regular police force may be recommended for these police officers, the Judge added.

It is time all those sitting in the representative bodies of this country from panchayats to the Lok and Rajya Sabha call on the concerned authorities to end impunity for police ill-treatment of the country’s citizens. I ask all these representatives to ask their State Governments to ensure that all complaints of police brutality are promptly, thoroughly, impartially and independently investigated and that those responsible are duly punished. These recent incidents are a blot on the government of Tamil Nadu and raise a number of concerns in cases involving the police. It is an absolute disgrace that police officers can behave in such a violent way towards the public. In the 60 years of independence, the country’s citizens have been the victims of tens of thousands of incidents of police brutality that would even shame Satan in hell. No wonder the police are often referred to as Yum Ke Doots. Shall we now start calling these women police Yum Ki Dootinis, Hedambas or Surpankhas?

The media and general public perception that women is always victim must change. Laws favor women and women who know this misuse it to blackmail. Even if the accused is judged innocent the damages are lasting. The women who frame people with such laws go scotfree, lay claims to public sympathy and alway be victims.

thanks to the editor and report for bothring to publish such atrical. even my case is also would have been re-union if the 498a is not filed and if i have not been arrested. I fild RCR under section 9 under imprestion that i would get my wife and child during the cort reconcilition but they had file case aganist me and my parents and losted everything in my life with in span of one year i have losted my grand ma and my father, my mother got ill. no ware i sapared. also i have seperated from my chiled. i don't know when can i see my chiled next. however such orders will help the some exten to reunion the family. i am very sure.

One of my frined says : Renukas words that she 'will teach men a lesson that their mothers had not taught them', seems to have been taken quite literally by the women police in Chennai. Stop this legal terrorism in India, otherwise the day indian men will wake up and will take the law in thier own hand , the crime will increse like any thing. Law makers wake up!!!
