Accident victim’s kin to get Rs 25 lakh

New Delhi, March 4 The family of a Canadian High Commission employee was awarded a compensation of Rs 25.5 lakh, excluding interest, by a court for his death in a road accident.

Naveen Saxena, a 30-year-old medical clerk in the immigration section of the Commission, was killed in Uttar Pradesh in December 2004 when a Tata Sumo in which he was travelling was hit by the offending vehicle. “There is nothing to disbelieve that the accident took place on account of rash and negligent driving by the driver of offending vehicle which is insured with National Insurance Company Ltd,” said Motor Accident Claims Tribunal (MACT) Judge A S Jayachandra, while directing the insurance company to pay Rs 25.53 along with an interest of 7.5 per cent per annum.

Of the compensation, 30 per cent (Rs 7.6 lakh) would go to Saxena’s wife, Pooja. His minor children Mayank and Navaya would share 20 per cent each of the relief (Rs 5.1 lakh each). His parents would get 15 per cent (Rs 3.8 lakh), the judge said in a recent judgement. The insurance company will deposit 50 per cent of the sum in fixed deposits and the rest will be paid to the family by cheque.

Saxena’s family had filed separate petitions in the court on January 28, 2005 and sought a compensation of Rs 80 lakh from the owner, driver and insurer of the offending vehicle citing their ‘loss of dependency’ due to his death.

Insurance company to pay Rs 84 lakh
A Delhi court had earlier ordered ordered an insurance company to pay a compensation of Rs 84.29 lakh to the parents of businessman Rahul Somani, who died after his car rammed a truck which was carelessly parked in the middle of a road on August 17, 1997.

Motor Accident Claims Tribunal (MACT) Judge Deepa Sharma had termed the “parking of the truck” as “negligence” and asked the United India Insurance Company Ltd to pay the family of the deceased the sum, along with interest at the rate of 7 per cent per annum. A claim for a compensation of over Rs 350 lakh had been filed.
