The Foreigners Regional Registration Officer in Kolkata had served him a notice on January 1, 2008, asking him to leave the country within 30 days. Afghan had entered India on March 23, 1984 through Amritsar. But was driven out from the city for alleged anti-national activities.
Though at that time, he was allowed to stay in New Delhi for three months, he came to Kolkata that very year. But even after the three-month period, Afghan did not leave the country. In 2002, the City Civil Court in Kolkata passed an order for his deportation, but surprisingly, he continued to stay on in Kolkata.
He married an Indian, and at present runs a business here.
Counsels for the Government of India had stated before the City Civil Court judge that Afghan had collected money from Afghanistan nationals for helping rebels there.
