A delegation of the association, Mumbai Rail Pravasi Sangh, submitted a memorandum to K C Jena, Chairman, Railway Board (CRB) on Wednesday seeking withdrawal of the cases. The association has also asked the railways to take back cases registered against commuters arrested during protests at Kalwa in December 2007 saying they were agitating for more and better services.
The Railway Police had arrested 32 commuters most of them women commuters on the charges of rioting. In Kalwa, the police had arrested 20-25 people for rioting. They were later released on bail.
“We have given a memorandum to the Chairman, Railway Board (CRB) to withdraw cases against commuters arrested by the police at Kalwa and Borivali. Since the nature of the crime in these cases is more or less the same, we want the railways to take back the cases,” said Madhu Kotian, member of the Divisional Railway Consultative Committee and president of the Mumbai Rail Pravasi Sangh.
“Most of the commuters booked are women working with the state government. Any legal case may either mean suspension or dismissal,” Kotian added.Meanwhile, legal experts said once an offence is registered it cannot be withdrawn. The accused can be discharged by the court after the prosecution (the police) asks the court to do so.
