Agency to pay Rs 50,000 for failing to deliver car on time

Chandigarh The District Consumer Disputes Redressal Forum has directed Berkley Automobiles to pay Rs 50,000 to a resident of Manimajra after failing to deliver a vehicle booked by him.

Shiv Kumar Khanna had booked the car for Rs 5.93 lakh with the Maruti Udyog Limited through Berkeley Automobiles on April 12 last year and paid Rs 25,000 as the booking amount.

The agency had then assured to deliver the car within three months. The complainant had taken Rs 4.40 lakh as car loan from the SBI.

After the lapse of three months, the agency asked for one more month. In August 2008, the agency allegedly refused to deliver the vehicle.

The company said the complainant was clearly informed that the delivery of the car would be subject to the supply of the particular colour chosen by him and the period was tentative.

It was asserted that the complainant did not turn up to take the car when informed about the delivery. But the complainant claimed the agency had delivered the vehicles to various persons within days of their bookings.

One Bhag Singh Jasrotia had booked the vehicle on March 21 and got the delivery on April 16. Similarly, one Didar Singh had booked the vehicle on March 27 and received the delivery on April 2.

Hearing both the parties, the consumer forum found the agency indulging in unfair trade practices.
