Aishwarya in tax net for claiming to be NRI

Mumbai, October 14: The Bombay High Court has admitted an appeal filed by the Income Tax authorities, challenging relief granted to Bollywood star Aishwarya Rai Bachchan by Income Tax Appellate Tribunal (ITAT).

A Division Bench headed by Justice S Radhakrishnan admitted the appeal by IT authorities over Aishwarya's tax assessment for the financial year 1996-1997.

The IT authorities moved to HC following ITAT's last year decision quashing an IT department decision to reopen Aishwarya's tax assessment.

IT Department's lawyer Benny Chatterjee argued that Aishwarya's income is not being questioned, but her getting exemption under NRI category is questionable.

The key issue is weather Aishwarya - who had won Miss World title just then - could claim to be a Non Resident Indian for that period, he added.

Aishwarya had declared her taxable income for the FY 1996-97 to be 2.14 lakh. But in 2003, the authorities decided to reopen the assessment, as her passport revealed that during the period she was not an NRI, as she had claimed to be.

She was not outside the country for 186 days within that period, as required to qualify for income tax exemption under the NRI category, authorities said. Therefore, she was asked to pay tax on the income of around Rs 26 lakh which she had earned abroad-after winning the beauty pageant with interest, they added.

this is a gimmick of the IT officials to be in the limelight at the expense of a mega celebrity. there are umpteen tax evaders and Tax authorities are not dared to touch them because of the political or other influence.

Please let her be. She has done us proud. Whether she stayed out of the country for 186 days or 180 days is just a small technicality. It should not cost her 26 lakhs. My heart goes out to her.First, her husband movie bombs at the box office. Then her father-in-law takes ill. Now this. How much can one family take? We owe them as Indians. Let them be.

Tax authorities should investigate also cricketers, filmstars who get gifts and do not pay taxes of the nation. Check the business men who travel to Gulf countries and the Income tax will get a bounty... .but our corrupt babus do not have the time or guts. Now with all the banks going bust in the Gulf and Switzerland, all the wealth of these businessmen who stole money of their own beloved country should diminish. Europe and USA who call themselves rich are just using this money free of cost, now they do not want to return - so this Economic Crisis. Indians who cheat the nation by keeping money in these tax havens should be a worried lot as all these so called banks of rich nations are about to steal this laundered money. INDIANS PAY YOUR TAXES AND KEEP MONEY IN OUR COUNTRY, LET OUR MONEY BE USED FOR DEVELOPMENT OF OUR NATION..... JAI HIND.

Well.. I am as much Indian as everyone else...(That so says title of my Post).But the issue here is not whether to criticise is anti national or not...the issue is that an Indian may earn as much...he/she would always apply for benefits from IT/customs...if they can buy/spend heavily on foriegn products, why cant they pay their taxes honestly...I heard Amitabh not paying customs according to his shopping in France...Sachin applied for tax break on his Ferrari...I mean why..if you have the money to spend...have they money to discharge your duties too...I do not hear any such instances with celebrities in other countries...reason may be that the media there does not believe in exposing such acts or such scoops do not take place in those countries...Anyways I m still proud to be an Indian...whether Corrupt or Dishonest...
