All 6 cops get bail in 2002 ‘fake encounter’ case

New Delhi, March 1 A city court has granted bail to six Delhi policemen chargesheeted by the CBI in a 2002 fake encounter case. The court held that the policemen “seemed” to be cooperating with the investigations.

Sub-Inspector Bal Krishan, Head Constable Mukesh and Constables Pramod, Harish, Jagmohan and Gajendra stand accused of abducting four men from Bahadurgarh and then shooting two of them in Jharoda Kalan. The agency claims it was a killing, given the colour of an encounter by planting guns.

The CBI says Najafgarh police registered a case on October 17, 2002 based on S-I Balkrishan’s complaint. Balkrishnan, then posted at Dhaula Kuan, claimed they were fired at while chasing a criminal, one Vivek, and his associates. His complaint says two of the alleged criminals — Vivek and Mandeep — were hit in the retaliatory fire.

The two were declared dead when brought to RTRM Hospital.

But deceased Mandeep’s wife filed a writ in High Court alleging that the police abducted her husband and three others from Bahadurgarh and then shot the two. The High Court had referred the matter to CBI. Post-probe, the agency chargesheeted the policemen on December 20, 2007.

The CBI chargesheet says witnesses interrogated from Dharm Vihar, Bahadurgarh, have stated that four men were abducted around 6 pm. The agency also claims the policemen’s version of the events is belied by their cellphone location at the time of incident.

The court, granting bail to all six on a personal bond of Rs 25,000 each, said since CBI had carried out its probe without arresting any of the accused it was clear they were presenting themselves whenever required.
