The American Center was attacked on January 22, 2001, by a militant group and five Kolkata Police personnel were killed in the shootout. On April 26, 2005, a trial court awarded death sentences to Aftab Ansari, Jamil Uddin Nasir, Mussarat Hussain, Hassarat Allam, Adil Hussain, Sakil Akhtar and Rehan Alam for their involvement in the attack. All have been in jail since 2001 and 2002 and had challenged the death sentence in the High Court last year.
On Monday, during his argument, Goswami left the death sentence of Hasrat Alam, Adil Hussain and Rehan Alam to be decided by a Division Bench of Justices Asim Banerjee and Kalidas Mukherjee. Jayanta Narayan Chatterjee, counsel of Hasrat and Rehan Alam and Hussain, said the police did not press charges of criminal conspiracy against them. They had just printed a few papers regarding a vehicle against a request of Mustaq, who was linked to a group. They were not involved in the American Center attack case and the Bench should set aside the death sentence of the three, pleaded Chatterjee.
