'84 Riots: Court tells CBI to file report in a week

New Delhi, March 12: A New Delhi court hearing a 1984 anti-Sikh riot case involving Congress leader Jagdish Tytler pulled up the CBI for failing to file a status report on the re-investigation ordered into the case.

"I have not asked you to file a chargesheet but a status report in the case. It was your duty to file the report," Additional Chief Metropolitan Magistrate Sanjiv Jain said.

Taking exception to the investigating agency's failure to file a report, the court asked it to file it within a week.

CBI counsel Sanjay Kumar told the court that after the re-investigation was ordered on December 18 it has questioned four witnesses in the case.

The investigating agency has also contacted a US-based man, Jasbir Singh, who had volunteered to depose in the case after the CBI had sought to close the case against Tytler.

A matter related to Singh's testimony is pending before the Delhi High Court. Singh had earlier expressed his inability to come to the country for recording his testimony and had expressed his willingness to record his testimony through video-conferencing.

The thrashing CBI got from SC yesterday on 1984 riots case is unbelievable and unparallel in the annals of history. But people should not forget that CBI though suppose to work independently but gets directions from the bosses of the day. Nevertheless, when a Sikh took over as PM, people saw a light at the end of the tunnel and thought they would see killers of sikhs in 1984 behind bars besides, will get some compensation. Instead what they got "nothing" and even some of those allegedly involved in slaughtering of sikhs, got ministerial berths in Shri Manmohan Singh's cabinet. Recently during Gujrat Assembly elections, PM is on record saying that if Congress comes to power in Gujrat, congress govt.will open the files of 2002 riots. What did stop him from opening the files of 1984 slaughter of thousand of sikhs since he took over as PM 4 years ago? All that glitters is not gold. A man is known by the company he keeps, therefore 1984 victims should not expect anything from the government headed by Manmohan Singh or the CBI but keep faith in SC and god willing some solace will be there shortly. God's mill grinds slowly but surely.

Perhaps 23 years are not enough to give justice to the victims of mass slaughter> Supreme Court is the only hope for the people of India after God. Therefore SC must force government to obey or face prison like other criminals. CBI is only an insitution or department which works according to the directions of the masters (The government of the day). Only SC can save the people from the clutches of the politicians who are calling the shots even if they are in Jails. A fullstop has to be put somewhere and that can be done by SC only.

In November 1984 following the assassination of Indira Gandhi, mobs lead by Congress leaders committed murder, loot, arson and rape, across India for over a week, however the worst effected area was the capital of India Delhi. Due to the large span of area the actual number of those dead is unknown, official figures of those who died are over 4,000 and 60,000 were rendered homeless in Delhi alone, these figures do not incorporate those “missing”. In April 2004 the Congress Party announced Sajjan Kumar, Jagdish Tytler, Ajay Makan, R K Anand and others allegedly involved in the Delhi massacres of Sikhs, as standing in elections to the Lok Sabha in and around Delhi. These individuals were indicted by independent commissions of inquiry, including the People's Union for Civil Liberties, the People's Union for Democratic Rights and the Citizens' Justice Committee. Numerous affidavits have been filed against the politicians for their role in inciting mobs. The G.T. Nanavati Commission looking into the riots, continued to receive affidavits from victims with details of the activities of Sajjan , Makan, Anand and Tytler at that time. Both Tytler and Kumar have won seats in the 2004 elections and are now MPs of the ruling Congress party. The non-resident affairs ministry had been given to Jagdish Tytler, who has been minister of state with an independent charge dealing with NRIs.

Senior Congress leader Jagdish Tytler had led a mob that killed two Sikhs at a gurdwara in the walled city and also burnt the shrine during the 1984 massacre, an eyewitness had told the Justice Nanavati Commission. Mr Surinder Singh, who was the Head Granthi of Gurdwara Pulbangash near Azad Market said the mob led by Congress MP Jagdish Tytler, attacked the shrine a day after the assassination of Prime Minister Indira Gandhi. “He incited the mob to burn the gurdwara and kill Sikhs,” he said in an affidavit filed before the commission probing the massacre. The mob carrying lathis, iron rods and kerosene attacked the gurdwara and set it on fire on being incited by Mr Tytler, he said. The rioters killed Thakur Singh, a retired Delhi police Inspector who was an employee of the gurdwara. The mob also burnt alive Badal Singh, a gurdwara ‘sewadar’ by putting a burning tyre around his neck, he added. The witness told the commission that rioters were raising slogans like “khoon ka badla khoon se lenge,” “Sardar gaddar hain”, “Mar do jala do”. Some people in the mob were carrying Congress flags, he added. “I was watching the entire incident helplessly from gurudwara’s top floor. The gurdwara was set on fire,” he said. Mr Surinder Singh said he and his family members were rescued by some Muslim neighbours in the night. After a week, when he returned to his house, he found that his house was also looted by the mob.

Now since the matter is pending before the court of law, all witnesses like Jasbir Singh in USA who has been following hide and seek game should appear before the court , so as to enable the Hon,ble court to come to a logical conclusion and pronounce its verdict to put an end to the long drawn out legal case

CBI has been asked to file status report and the court will take notice of what is submitted anddraw it's own inferences.Readers have lost sight of subject matter and resorted to hate campaignbetween communities and political ideologies.Like all sikhs cannot be blamed for Mrs Gandhi's death similarly all members of congress cannot be blamed for 1984 riots.There will be no end to allegations and counter allegations.Then some will dig up Godhra,other will raise Punjab militancy.We need to move forward and not fall in the trap laid by leaders who fan unrest. Let judiciary perform and let us have faith in them.

CBI should be dismantled by jatin on 12 Mar 2008

Prosecution rate of CBI for high profile cases involving political and financial mafias are just pathetic. Many people allege that CBI itself is highly corrupt and interested only in their “hafta” while “investigating” crimes. Supreme Court also has indicted that many times. CBI should be dismantled and a new agency should be created from the scratch.

CBI is nothing but a backboneless eunuch agency which is only good to lick boots of its political masters. In India, any scam is used only to bargain during political horse trading. None of the political or financial crimes are prosecuted and criminals are brought to justice. Not a single high profile Indian industrialist or businessman or politician has ever been successfully prosecuted by CBI, EVER. Central agencies like CBI help India to remain a third world country.

A woman from Trilokpuri described her harrowing experience. She and her husband, a Labana Sikh, originally from Sind, had migrated to Rajasthan in 1947. About fifteen years ago they had moved to Delhi in search of better prospects. During the slum clearance drive of 1974-75, they had been resettled in Trilokpuri.She and her husband and three of their children survive but the eldest son aged 18 was killed on 1 November. She described the mob led by the Congress-I block pradhan as consisting of some people from the same block and others from neighboring blocks and nearby villages. While the block pradhan identified Sikh houses and urged the mobs to loot, burn and kill, the women were herded together into one room. Some of them ran away but were pursued to the nearby nallah where they were raped. Their shrieks and cries for help fell on deaf ears. From among the women held in the room, the hoodlums asked each other to select whomsoever they chose. All the women were stripped and many dishonoured. She herself was raped by ten men. Their lust satisfied, they told the women to get out, naked as they were. For fear of their lives they did so, hiding their shame as best as possible. Each begged or borrowed a garment from relenting neighbors and sought shelter wherever they could.
