Justice D N Patel gave the bail on two personal sureties of Rs 25,000 and Rs 10,000 on the condition that he would not enter the revenue limits of Porbander district. A limestone royalty theft was registered against the BJP leader and three others at Bagvadar Police Station of Porbander. Following this, he surrendered on November 14, 2007 at the Ahmedabad Airport on his return from the UK.
Bokhiria was allegedly involved in conducting mining of limestone and other minerals without having an official lease of the land. This resulted in evasion of royalty payable to the government and crores of tonnes of illegal mining. In September last year, the Gujarat High Court had ordered his arrest while acting on a PIL. Earlier, both the High Court and the Supreme Court had rejected his anticipatory bail plea.
Advocate Prakash M Thakkar, who appeared for Bokhiria, said, “The maximum punishment possible for the offence he is charged for is three years and the trial has to be conducted by a magistrate. Also, two other accused in the case have already been granted bail and are under police protection now. All this factors were appreciated by the court while granting bail to Bokhiria.”
