Bhatt posters: Congress leader gets bail

Ahmedabad Publication of posters carrying excerpts of an open letter written by suspended IPS officer Sanjiv Bhatt to Chief Minister Narendra Modi, prima facie, doesn't amount to constitute an offence of disturbing the communal harmony or defamation, Surendranagar Sessions Court has observed while granting anticipatory bail to a local Congress leader in Surendranagar – Naushad Solanki – recently.

According to the details available, some posters sprung up near the venue of Modi's Sadbhavna Fast in Surendranagar on January 16. The posters were featuring excerpts of Bhatt's open letter to Modi along with the former's photograph.

The posters in Gujarati quoted Bhatt as saying, “I have principles, but no power. You (Modi) have power, but no principles. There is no scope for compromise.” The posters, also carrying pictures of Bhatt in police uniform, came up across Surendranagar city on January 16 urging people to join Congress party's Satkarma Fast against Modi's Sadbhavna Fast.

On January 17, Surendranagar police had suo motu registered a case in this regard against unnamed persons holding them accused of printing defamatory material which could promote enmity between different groups in society.

During investigation, police found that the posters were printed by Solanki who is spokesman of Surendranagar Congress Committee who happens to be the son of Surendranagar District Congress President.

Apprehending his arrest, Solanki had moved an anticipatory bail petition before Surendranagar district court. He had called the complaint as politically motivated as he belongs to Congress party.

Allowing the petition, Additional Sessions Judge D T Soni has observed that it does not feel that the impugned writing on the banner on which the FIR is based is defamatory at all or which has violated the communal harmony among public.

The court has also agreed to Solanki's argument that the letter was available on the website of a national news channel since September 15 last year and till date no complaint was lodged against the same.

With these observations, the court has granted conditional anticipatory bail to Solanki ordering him to present himself before the police on January 30.
