Earlier, a BMC survey had revealed twenty flats in the suburbs — taken over as tenements for the PAPs by the BMC — have been sold off by six developers. Now, according to a complaint filed with the civic administration, 14 tenements in Dadar (west), Nunus Wadi near Siddhivinayak temple — taken over by the SRA — might have been sold off or rented.
Chief Inquiry Officer, SM Vashi, who is investigating the trespassing of PAP tenements, said, “We are investigating 14 SRA tenements located at Dadar. The details of the exact number of flats and whether they have been sold or rented is yet to be known. After speaking with SRA officials and site inspection a report will be submitted,” she said.
Joint Municipal Commissioner (improvements) V Radha who is looking into the trespassing of the PAP tenements said there is a possibility of many such cases. “We are investigating the cases and will take legal action after inspection,” she said.
Radha said she has already received approval from Municipal Commissioner Jairaj Phatak to file an FIR against six developers: Rizvi builders headed by Rajyasabha MP AH Rizvi, NS Patel developers, SM Developers, Amit developers, Deladia developers and builders and developers' private limited and Hemal construction.
“A team of civic officials visited the Bandra police station late in the evening. The FIR will be filed by Thursday,” she said adding, “The matter is serious and accordingly legal action has been sought. The builders are not ready to hand over the same flats which were reserved, as they have been sold or rented out,” she said. Radha added that BMC’s main concern is to get the flats back. “We want the 20 flats back. Eviction action will begin after considering the legal problems.”
After the BMC identified six developers for trespassing 20 PAP tenements in suburban part of the city, a show-cause notice was issued to the developers but except for Rizvi builders and Hemal constructions, none replied. Rizvi developers said they were ready to handover the four flats in the adjoining building provided BMC makes payment with interest.
Radha said that the demands of the developers was not valid and therefore the civic administration had to resort to legal action. “The developers are at fault and if we agree to their demands, it will set a precedence,” she said.
The BMC requires upto five lakh PAP tenements for rehabilitation on various projects including BRIMSTOWAD, water pipelines, roads and others. It currently has 250 PAP tenements. The civic administration now plans to speed up its policy on tenements for rehabilitation and prepare a masterplan for constructing structures for PAPs.
