The CBI’s report will be opened only after the state government files its affidavits, court officials said.
It is also learnt the CBI is persisting with its earlier observation that Rizwanur Rehman committed suicide.
The CBI has investigated the circumstances that led to the 30-year-old graphic designer’s death, and also the roles played by several people including police officers and Rizwanur’s father-in-law, businessman Ashok Todi in abetting a possible suicide.
It is also learnt the report has not taken a final call on the people to be chargesheeted in the case, including two senior IPS officers of the Kolkata police — Mr Gyanwant Singh and Mr Ajay Kumar.
However, the CBI has not approved of these officers speaking to Rizwanur and his wife Priyanka after their marriage.
Prasun Mukherjee, who was removed as commissioner following public outrage over Rizwanur’s death, told The Indian Express: “I have heard the CBI has submitted its report. It is still confidential. I cannot comment unless I learn what the report has said.”
CBI sources said Prasun Mukherjee was not directly involved in coercing Rizwanur and Priyanka to stay apart.
However, four other officers — former deputy commissioners Gyanwant Singh and Arun Kumar, officer-in-charge Sukanti Chakraborty, sub-inspector Krishnendu Dey — have gone beyond their bounds in trying to interfere in a marriage between two consenting adults, the report says.
But top bosses are still undecided on whether to name these officers in the chargesheet or on the charges to pin on them.
A CBI officer said, “There is no concrete evidence proving that Mukherjee asked the couple to separate or even threatened Rizwanur. Other officers pressurised Rizwanur. There is enough evidence of that.”
Officers admitted there were grey zones in the investigation, areas in which they had not been able to “lift the clouds totally”.
An officer said some missing links are buried with Rizwanur forever.
He said, “We have not been able to ascertain why Rizwanur went to Patipukur. He was very depressed at that time. The reason could be that he wanted to be away from everybody and chose a quieter spot to be with himself. Perhaps, when one wants to end one’s life, he chooses a place where he can be completely anonymous. That could be why Rizwanur went to Patipukur, and not Park Circus which is nearer to his home.”
The CBI has said a final report with the chargesheet will be placed before the Bankshall Court soon.
The present report enlists 315 documents, including letters and other necessary evidence.
The CBI has found that Priyanka’s father Ashok Todi, uncle Pradip Todi, Anil Saraogi, a member of Rizwanur’s family and the above-mentioned four police officers played an “active role” in trying to break up the marriage.
The agency also found the last written piece of Rizwanur which he had typed on a computer in his aunt’s house the night before his death. It is a part of the documents submitted on Tuesday.
“There is no reason to treat this as a suicide note,” explained a CBI official.
“It can be read in many ways, particularly as a reflection of Rizwanur’s mental agony that night,” he added. The report stated that Priyanka Todi gave conflicting statements to the investigating agency.
